416 ARTICLE 72.

specters are authorized and directed to visit places where oysters caught
within the limits of the State of Maryland in less than cargo lots are sold,
and get from such sellers, a statement under oath as to the number of
bushels sold from time to time and return to the general measurers and
inspectors a certificate thereof to be forwarded to the Comptroller as re-
quired in the case of certificates for cargoes, and the payments of the
amounts so found to be due shall be similarly enforced. All oysters found
within the State of Maryland shall be presumed to have been caught with-
in the limits of the State of Maryland and the burden of proof shall be
upon any one claiming to the contrary to establish his said claim by clear
and satisfactory evidence. All such general measurers and inspectors or
special inspectors may be removed at any time by the Conservation Com-
missioner for neglect or malfeasance in office. The said Commissioner
shall furnish to each of the said special inspectors certificates in book form,
supplied with carbon paper, so that each of the said triplicate certificates,
shall be exactly the same; the form of the certificates shall be as follows:

to contain......... bushels of merchantable oysters and........ bushels

of unmerchantable oysters. 1

82A. It shall be unlawful for any person to carry or attempt to carry
or buy for the purpose of carrying out of the State any oysters taken from
the natural rocks, beds or bars in the waters of this State, until he has
first obtained for each cargo a permit to do so from the Deputy Com-
mander or Inspector from whose district said] cargo is to be taken, and
has paid to the Deputy Commander or Inspector an inspection tax of four
cents per bushel on the number of bushels in said cargo in order to defray
the cost of such inspection; said inspection tax on oysters shall attach ir-
respective of actual sale of oysters and shall be effective prior to shucking
or shipping same.

Any person violating the provisions of this section shall upon conviction
be fined the sum or not less than one hundred dollars nor more than two
hundred dollars and the beat or vessel, together with her tackle used in
the violation shall be forfeited to the State to be dealt with in accordance
with Section 31; and all oysters found on said vessel shall be returned to
the beds whence taken.

All taxes collected under the provisions of this Section shall be remitted
to the Conservation Department and forwarded to the Comptroller or
State Treasurer to be placed to the credit of the Conservation Fund.
