cross section of the tire is not maintained, and no motor vehicle, equipped
with four wheels, of which the weight of the vehicle and the load com-
bined exceeds twenty-five thousand (25, 000) pounds shall be operated on
any highway of this State, and no motor vehicle, equipped with six wheels,
of which the weight of the vehicle and load combined exceeds forty thou-
sand (40, 000) pounds, shall be operated on any highway of this State.
Except in the case of motor vehicles now owned and heretofore registered
in this State, no certificate shall be granted for the registration of any
motor vehicle, equipped with four wheels, having a rated carrying capacity
of over five tons, nor of any motor vehicle, equipped with six wheels,
having a rated carrying capacity of over ten tons, and, except as afore-
said, no motor vehicle, equipped with four wheels, having a greater rated
carrying capacity than five tons, and no motor vehicle, equipped with six
wheels, having a greater rated carrying capacity than ten tons shall be
operated over any public highway in this State, these provisions being
absolutely necessary in the opinion of the General Assembly for the
proper protection and continued maintenance of the public highways of
this State.
No motor vehicle shall be operated with a greater load than that for
which a registration certificate has been issued and fee paid.
(3) Speed of Other Vehicles.
No motor vehicle shall be operated upon any public highway of this
State at a rate of speed exceeding twenty miles an hour in the thickly
settled or business parts of cities, towns and villages, or twenty-five miles
per hour in the outlying or not thickly settled parts of cities, towns or
villages. If the rate of speed of a motor vehicle operated upon any public
highway exceeds thirty-five miles per hour in the open country outside of
the limits of cities, towns or villages, such rate of speed shall be prima
facie evidence that the person operating such vehicle is operating the same
at a rate of speed greater than is reasonable and proper, and in violation
of the provisions of this section, and the burden of proof shall be upon
him to show that such rate of speed was not greater than was reasonable
and proper, as above set forth. No motor vehicle equipped with a com-
mercial body, the weight of which, including the body and load, is greater
than three (3) tons shall be operated at a rate of speed greater than twenty-
five miles per hour under any circumstances.
(4) Maximum of Speed.
No motor vehicle shall be operated upon any highway of this State at
a rate of speed greater than forty miles per hour under any circumstances
or conditions.
(5) Penalties.
Any person violating any of the provisions of sub-sections (1) or (3)
of this section, shall be deemed guilty of a misdemeanor and subject to a
