948 ARTICLE 26.

An. Code, sec. 59. 1916, ch. 326, sec. 13.

59. Any person who shall willfully contribute to or encourage delin-
quency or dependency of any minor as hereinbefore defined; or any per-
son charged by law with the care and support of any minor who shall
willfully neglect to care for or support such child, or any person who shall
advise or encourage any child to leave the home, school, or institution to
which such child shall have been committed by any Court of competent
jurisdiction, shall be guilty of a misdemeanor and shall be fined or im-
prisoned or both in the discretion of the Court trying such offense or the
justice in the cases where the justice has jurisdiction.

60. Nothing in this sub-title shall be construed to affect, modify or
abridge the jurisdiction of Justices of the Peace in and for any County
for which no Judge has been assigned for the hearing, trial and deter-
mination of the cases of dependent, neglected or delinquent children as
provided in Section 49, or in any County where such assignment when once
made has been annulled, revoked or remains no longer in force for any
cause whatsoever; and in any such County the forms of commitments by
Justices of the Peace shall not be affected by anything in this sub-title
contained, but all such commitments in such Counties as would have been
good and valid before the passage of this sub-title shall be taken and held
good and valid, anything in this sub-title to the contrary notwithstanding.

61. The provisions of this sub-title shall be construed as conferring
additional and supplementary powers and jurisdiction on the Circuit
Courts for the several Counties, and not in substitution of or in conflict
with any other powers possessed by any of said Circuit Courts under any
existing general or local laws.1

62. This sub-title shall not apply to Baltimore City.

Minors Without Proper Care or Guardianship.

An. Code, sec. 63. 1916, ch. 674, sec. 1.

63. Any parent, guardian or person having the custody, control or
supervision of any child defined by the statutes of this State as a minor
without proper care or guardianship, or any person who shall knowingly
or wilfully encourage, aid, cause, abet, or connive at such state of absence
of proper care or guardianship of a minor, or who shall knowingly or wil-
fully do any act or acts to directly produce, promote or contribute to the
conditions which render such child a minor without proper care or guard-
ianship, or who having the custody, control or supervision of such child,
shall wilfully neglect to do that which will directly tend to prevent such a
condition, or to remove the conditions that render such a child a minor
without proper care or guardianship shall be proceeded against as pro-
vided herein.

1 Sec. 16 of act of 1916, ch. 326, provides for the repeal of all laws or parts of laws in
conflict with said act of 1916, to the extent of such conflict.
