An. Code, sec. 352. 1906, ch. 582.

387. Any person who shall knowingly, wilfully or falsely represent to
any licensed inn keeper, restaurant keeper or other person or persons
engaged in the sale of intoxicating liquors, any minor to he of full age for
the purpose of inducing any such licensed inn keeper, restaurant keeper or
other person or persons engaged in the sale of intoxicating liquors to sell
or furnish any intoxicating liquors to said minors shall be deemed guilty
of a misdemeanor, and upon conviction thereof shall be sentenced to pay a
fine of not more than twenty-five dollars ($25) or undergo an imprisonment
in jail for a period not exceeding thirty days; or both, in the discretion of
the court.

388. Any person under the age of twenty-one years who shall knowingly
and falsely represent himself to be twenty-one years of age to any licensed
inn keeper or other person engaged in the sale of intoxicating liquors, for
the purpose of procuring or having furnished to him, by sale, gift or other-
wise, any intoxicating liquors shall be deemed guilty of a misdemeanor, and
upon conviction thereof in any court of competent jurisdiction shall be
sentenced to pay a fine of not more than twenty-five dollars ($25) or im-
prisoned in jail for a period not exceeding thirty days.

Minors—Sale of Cigars and Tobacco to.

389. It shall not be lawful for any dealer, vendor or other person or
persons or body corporate engaged in the manufacture of cigars, cigarettes
or tobacco, or in any occupation in which the buying or selling of said goods,
wares and merchandise shall constitute the whole or any part of his, her,
its or their occupation, to sell, barter or give any cigar or cigars, cigarette
or cigarettes, smoking or chewing tobacco to any minor under the age of
fifteen years, unless previously authorized in writing by the parent or
guardian of such minor, or unless such minor is acting solely as the agent
of his employer; nor shall it be lawful for any person not a dealer to pur-
chase for any minor any cigar or cigars, cigarette or cigarettes, smoking or
chewing tobacco.

390. Any person or persons or body corporate being a manufacturer,
dealer, vendor as aforesaid, or any other person or persons or body corporate
violating the provisions of the preceding section, shall, upon conviction
thereof in any court of competent jurisdiction, be fined in a sum of not less
than ten dollars nor more than one hundred dollars for each and every
offense, or imprisoned in jail for not less than five nor more than thirty
days in default of payment of said fine.
