anyone visiting the premises of such licensed person, where spirituous,
malt or intoxicating liquors of any kind are sold or bartered, or offered for
sale or barter, any viands, food or lunch of any character, except as herein-
after provided, for the purpose of inducing, procuring or influencing the
person to whom the same may be offered, to purchase in any quantity,
spirituous, malt or intoxicating liquor to be drunk on the premises of such
licensed person, shall be deemed guilty of a misdemeanor, and on convic-
tion, shall be punishable by a fine of not more than ten dollars for each
offense; provided, however, that this section shall not operate to prohibit
the placing on the counters of such licensed person, pretzels, cheese or
crackers for the use, without cost thereto, of the patrons of such licensed
person; and provided further, that the placing by such licensed person of
any viands, food or lunch, other than that hereinbefore excepted at any
place on his premises for the free use of his patrons, shall be prima facie
a violation of this section.

Liquors—Hours of Sale of Regulated.

335. It shall be unlawful for any licensee before the hour of 7 A. M.
and after the hour of 6 P. M. to sell, barter or give away, or suffer to be
sold, bartered or given away, any spirituous, fermented, distilled, vinous,
intoxicating or alcoholic liquors (other than malt liquors containing less
than 4% of alcohol by weight) in bottles, casks, containers, packages or
other vessels or receptacles for the purpose of being taken, carried away
or removed therein from the licensed premises. Any person who shall
be convicted of violating any of the provisions of this section shall be sub-
ject to a fine of not less than $100.00 nor more than $500.00; and if suffi-
cient cause shall at any time be shown or proof made that any said licensee
has violated any of the provisions of this section, his, her or its license
shall be revoked by the Circuit Court of the County wherein said viola-
tion shall occur, or if in Baltimore City by the Criminal Court of Balti-
more City or by the Board of Liquor License Commissioners for Baltimore
City.1

This section referred to in upholding the war power of congress to make Volstead
act applicable to malt liquors with alcoholic content of one-half of one per cent.
