minent danger thereof, to increase the force herein provided for and to
organize the same as the exigencies of the service may require. The
Governor shall have power at any time to change the organization of
regiments, battalions, troops, batteries, companies, divisions, corps or
departments so as to conform to any organization, system of drill or
instruction, now or hereafter adopted by the Army or Navy of the
United States; and for that purpose the number of officers and enlisted
men of any grade or regiments, battalions, troops, batteries, companies,
divisions, corps or departments may be increased or decreased to the
extent made necessary by such change; Provided, that commissioned
officers who shall become surplus may be relieved from active duty and
placed upon the unassigned list, and shall be available for detail to
active duty at the pleasure of the Governor.

20. The Governor as Commander-in-Chief by executive order shall
fix the number of officers and enlisted men that shall compose the
strength of the several departments, corps and tactical units of the
Maryland National Guard, provided, however, that in time of peace the
minimum enlisted strength of a company, troop, battery, or division
shall not be less than forty men.

21. At any time upon the report of and recommendation of the
Brigade Commander, that any company or separate organization is not
up to the proper standard of numbers (minimum of forty), efficiency
or discipline, the Commander-in-Chief may, in his discretion, muster
out of service such company or separate organization so reported ineffi-
cient, and thereupon the commissions of all the officers of such com-
pany or separate organization shall be vacated; and at any time upon
the report and recommendation of the Adjutant General, after an
inspection by him ordered or made of any division of the Naval Brigade,
that such division so inspected is not up to the proper standard of
efficiency or discipline, the Commander-in-Chief may, in his discretion,
muster out of the service such division so reported inefficient, and there-
upon the commissions of all officers of such division shall be vacated.

22. That thereafter commissioned officers of the National Guard
shall be selected from the following classes and none other: First,
officers or enlisted men of the National Guard recommended by the com-
manding officers of their several independent battalions, regiments, and
higher units: second, officers on the reserve or unassigned list of the
National Guard; third, officers, active or retired, and ex-officers of the
United States Army, Navy and Marine Corps; and, fourth, graduates
of the United States Military and Naval Academies and graduates of
