.gases; provided that this regulation shall apply only to a motor vehicle
propelled by an internal combustion engine, and only within the limits
of cities, towns and villages in the State of Maryland.
(5) PENALTIES. Any person violating any of the provisions of this
section shall be deemed guilty of a misdemeanor and upon conviction
subject to a fine of not less than five dollars ($5.00), nor more than
iifty dollars ($50.00) for the first offense.
All the provisions of this section 148 shall apply both to the operator
of a motor vehicle and to the owner who causes or permits such motor
vehicle to be equipped or operated contrary to any of such provisions.
No negligence held to be imputed to a chauffeur under section 150 of the
code of 1912; the chauffeur testified that he did not see the plaintiff until
she was within a few inches of the machine. A chauffeur need not sound
his horn every time he passes around other vehicles standing in the street,
as the wagon in question was; at all events it cannot be said that the
omission to sound the horn caused the accident. Sullivan v. Smith, 123
Md. 554.
The failure of a plaintiff to comply with section 149 of the code of 1912
as to lights, referred to in deciding that he could not recover for injuries to
his automobile due to a collision. Gittings v. Schenuit, 122 Md. 285.
Evidence as to the absence from an automobile of the lights required by
section 149 of the code of 1912. held sufficient to take the case to the jury.

Speed of Motor Vehicles.
(1) GENERAL PROVISIONS.
1916, ch. 687. 1918, ch. 85, sec. 149.
149. No person shall operate a motor vehicle of any kind, as
defined in this sub-title, over any public highway of the State reck-
lessly or at a rate of speed greater than is reasonable and proper, hav-
ing regard to the width, traffic and use of the highway, or so as to
endanger the property and life or limb of any person, or without due
regard to wear upon said highway, so as not unnecessarily or unrea-
sonably to damage the same.
(2) SOLID TIKE MOTOR VEHICLES.
The maximum rate of speed for motor vehicles equipped wholly or
in part with solid tires which motor vehicles, including the weight of
the truck and the load thereon, weigh two tons or less shall be twenty-
five miles per hour. The maximum rate of speed for motor vehicles
equipped wholly or in part with solid tires which motor vehicles,
including the weight of the truck and the load thereon, weigh in excess
of two tons and not in excess of six tons, shall be fifteen miles an hour.
The maximum rate of speed for motor vehicles equipped wholly or in
part with solid tires, which motor vehicles, including the weight of
the truck and the load thereon, weigh in excess of six tons, shall be
