7. Repealed. (Act 1918, ch. 88.)
The act of 1902, chapter 208, held to violate article 3, section 29 of the
constitution; see notes thereto. Assuming that the rule that an entire act
will not be stricken down because one provision is void unless the provi-
sions are so connected that it cannot be presumed the legislature would
have passed one without the other, and that this rule applies where the
valid and void provisions are in the same section of the act, still an indict-
ment under the act of 1902 was insufficient. If the whole act of 1902 were
bad, which the court does not decide, an indictment was not sustainable
under the act of 1900, chapter 404. State v. King, 124 Md. 497.
