40. No clerk shall deliver the laws and public documents sent to
him. by the librarian to any other person than to him who is entitled to
receive the same, or to his order in writing, under the penalty of fifteen
dollars.

41. The clerks of the circuit courts for the several counties, and
the clerk of the Baltimore city court shall receive and file, without fee
or reward, the dockets and papers of justices of the peace delivered to
them, and shall give transcripts thereof for the usual fees, and shall
re-deliver the same to the justice upon his re-appointment.

42. In case of the death, resignation, disqualification or removal
from office of a notary public, his register and other public papers shall,
within sixty days thereafter, be lodged in the office of the clerk of the
circuit court for the county, or superior court of Baltimore city, who
may bring and maintain actions of trover, replevin or detinue for the
same; and such register or public papers shall not in any case be
liable to be seized or taken in execution for debt, or for any demand
whatsoever.

43. The clerk of the court of appeals shall have the custody of all
the records and papers in the office of the late court of appeals, of the
former court of appeals, and of the general court. He shall receive a
salary of $3,000 per annum, for which sum, to be paid out of the treas-
ury, the comptroller of the State shall draw his warrant. Said clerk
may appoint, subject to the approval of the judges of the court of
appeals, such deputy clerks as the requirements of his office shall neces-
sitate, who shall perform such duties as shall be prescribed by the said
judges and clerk, and shall receive such salaries as the said judges and
clerk may determine to be just and proper compensation for their serv-
ices, to be paid in the same manner as is hereinbefore provided for the
payment of the salary of the said clerk of the court of appeals. The
said clerk of the court of appeals shall render an account, as now pre-
scribed by law, of all fees, emoluments and receipts of his said office,
and shall pay the same to the treasurer of the State, as now required
by law. The clerk of the court of appeals shall provide his office with
such record books, dockets, etc., as may be suitable and necessary: and
the sum of eight hundred dollars, or so much thereof as may be nec-
essary, is hereby appropriated to pay for the same and such other nec-
