2108 TESTAMENTABY LAW. [ART. 93

ceding section, in reference to executors shall be construed to make the
bond of such executor or administrator liable for a claim so given in
or established, if such executor or administrator shall have been
insolvent or unable to pay his debts at the time of his qualification as
such executor or administrator; provided, however, that all commis-
sions allowed to such executor or administrator in the estate shall be
applied towards the payment or satisfaction of the claim so given in
or established before he be allowed to retain any portion of such com-
missions, and his bond shall be responsible for failure to make such
application.

Since this section and sections 244 and 246 make provision for proceed-
ings against delinquent administrators or co-administrators, equity will not
interpose in such cases. Whiting v. Whiting, 64 Md. 161; Linthicum v. Polk.
93 Md. 94.

230. The purchase money of land, sold by a decedent and con-
veyed by his administrator after his death received by the adminis-
trator, shall be returned as a separate debt due .the estate of the
decedent.

231. The judges of the orphans' court of the several counties shall
each receive the sum of four dollars for every day's attendance upon
the sessions of said court, to be paid at least as often as at the end of
each and every quarter after the qualification of said judges by the
counties, provided that St. Mary's county be exempted from the pro-
visions of this section. The judges of the orphans' court of Baltimore
city shall receive nine dollars for every day's attendance upon the ses-
sion of said orphans' court of Baltimore city, to be paid by the city
of Baltimore at the end of each and every month, and the sessions of
said orphans' court of Baltimore city shall continue from 11 A. M.
to 3 P. M., if necessary, for the transaction of the business of the
court, and provided that all provisions of any public general law or
any public local law inconsistent herewith be and the same are hereby
repealed.

232. The governor shall, of the three persons elected judges of
the orphans' court in the several counties and the city of Baltimore,
designate and commission one as chief judge of his respective court.
