the appropriations hereunder, or other moneys available to pay the
same, shall be thereupon certified to the comptroller of the State of
Maryland, who shall promptly pay the same to the contractor or other
persons to whom the said amounts may be due, it being the intent and
purpose of this section that the cost of the state-aided roads provided
for in this article shall be equally divided between the State and the
county in which such roads may be located; that such cost shall be
promptly paid, both by the State and the county, as the work pro-
gresses, and is approved by the state roads commission; which said
state roads commission, for the purpose of certifying the amount due
from the State and any county, shall have -the right to reject or allow
any exception or objection made as aforesaid in behalf of any county.
When the comptroller is authorized to pay the state's one-half of the
costs and expenses to the county commissioners. This section referred to
in construing section 71. Frederick County v. Fout, 110 Md. 173 (decided
prior to the act of 1910, ch. 217).

damages caused by the construction or improvement of any road shall
bo paid by the State.

77. No one county of the State shall receive in any year a larger
proportion of the total amount appropriated by this sub-title for said
year than the proportion which the then existing miles of public road
in said county bear to the then existing miles of public road in all of
the counties applying as determined by the said state roads commis-
sion, unless a balance remains unallotted under the arrangement above
prescribed, in which event said balance may be apportioned in the
same manner among the counties which have not received the full
amount of their applications.

78. Any road constructed under the provisions of this sub-title shall
thereafter be a county road, and the duty of keeping the same in repair
shall devolve upon the county in which it is situated; and all other
powers and duties respecting such roads shall be imposed upon and
vested in said county; and the board of county commissioners shall pro-
vide all moneys necessary to keep in a proper state of repair the roads
constructed under this sub-title, and it shall be the duty of the state
roads commission to notify said board of county commissioners of all
such repairs as they may deem necessary to be made to such county
roads; and immediately on such notification the board of county com-
missioners of such county shall cause such repairs to be made accord-
ing to the direction and to the satisfaction of said state roads commis-
