ing to pass an examination satisfactory to said board. The boards
so appointed shall be named for a specific term of service.

35. When the governor desires to create new organizations he
shall have power in the first instance to appoint all the officers neces-
sary to coTnTnp.np.fi and complete such organizations.

36. Officers of the line of the brigade shall be elected as follows: The
brigadier general by the ballots of the field officers of the brigade;
colonels and lieutenant colonels by the ballots of the other field officers
and the company officers by their respective regiments; majors by the
ballots of the company officers of their respective regiments; captains
and lieutenants of companies, the troop of cavalry, the battery of artil-
lery and the signal corps by the ballots of the enlisted men in said
respective organizations. The captain, commander and lieutenant
commander of the naval brigade shall be elected by the ballots of all
other line officers of the naval brigade. The division officers of the
naval brigade shall be elected by the ballots of the enlisted men of
their respective divisions.

37. The governor and commander-in-chief, at his discretion, shall
issue orders for the election of the brigade commander and command-
ing officer, naval brigade. The commanding officer, first brigade, shall
issue orders for the election of the field officers of the respective regi-
ments and all officers of the separate organizations of the brigade.
The commanding officers of the regiments and the naval brigade shall
issue orders for the election of the company and divisional officers of
their respective organizations. The officer ordering an election shall
detail an officer to preside thereat, and shall give or cause to be given
at least five days' notice to all qualified voters when and where and
for what office the election is to iake place. Such notice shall be served
on the persons entitled to vote at such election in the same manner as
warnings for duty are given. If it shall so happen that those entitled
to vote at said elections shall not have received legal notice, then the
officers detailed to preside at said election shall have the power to
adjourn the meeting and cause such notice to be given; but the pres-
ence of a person entitled to vote at said election shall be deemed a
waiver of his right to take exception to the want of legal notice to
him. A majority of those entitled to vote must be present before an
election can be held. The election must be by ballot, and a majority
of the votes of all persons present at an election shall be necessary to
a choice. The presiding officer shall at once notify the person elected
in writing of his election. If a person elected at any such election
shall not, within ten days after being notified of his election, signify
