LAND OFFICE.

Commissioner — Powers and Duties.

1. Commissioner a court of record.
2. Appointment and salary of chief
clerk and assistant clerks.
3. Appointment and salary of clerk to
complete indexing.
4. Summons for witnesses; taking
depositions.
5. Writs, attachments, etc., to be
served by sheriff.
6. Docket.
7. Papers to be recorded.
8. Fees for recording.
9. Seal.
10. Chancery records and ante-revolu-
tionary papers.
11. Copies of chancery proceedings ;
fees.
12. Bond.
13. Moneys due the State on account of
public lands, how payable.
14. To record certificates and Issue pat-
ents,
15. Laud records; copies.
16. Maps, records, etc., of shell fish
commissioners; copies.
17. Extracts of deeds transferred from
clerks of courts to be filed and
bound. Appropriation therefor.
Such extracts to be indexed.
Comptroller's warrants for costs
thereof.
18. Authority of commissioner to con-
tinue indexing land records and
deeds.
19. Appropriation of one thousand dol-
lars annually for such costs
20. British confiscated lands.
21. Advertisement of intent to apply
under preceding section.

22. If not contested; if contested.
23. Hearing; ex parte determination
reasons to be filed.
24. Disputes before commissioner; de-
cree.
25. Disputes in which commissioner is
interested.
26. Vacant or escheated land.
27. Special and proclamation warrants
notice.
28. Where the land lies in two counties.
29. Warrant of resurvey to add contig-
uous vacancy.
30. Warrant of resurvey where owner
does not wish to add contiguous
vacancy.
31. Notice of resurvey.
32. Surveyor's return to land office. Pat-
ent to be Issued.
33. Escheat warrant.
34. To be executed within six mouths ;
no renewal after six months.
35. Payment for vacant or escheated
land.
30. Amount due the State to be a lieu
upon the land surveyed. Proceed-
ings to enforce such Hen.
37. First applicant entitled.
38. Value of land and improvements to
be returned by surveyor; his
omission to be no cause of caveat
39. Certificate of survey returnable
within six months.
40. Certificate to be recorded if correct ;
if incorrect to be corrected by
surveyor.
41. When patent shall issue.
42. Caveats; when to be heard.
43. Costs of caveat.
44. Signature of governor; great seal.
