SEC. 104. To the State Roads Commission the sum of fifty
thousand dollars ($50,000.00) for the fiscal year nineteen hun-
dred and eleven and a like sum of fifty thousand dollars ($50,-
000.00) for the fiscal year nineteen hundred and twelve, said
sums to be used in the construction of State road number one,
provided that the construction thereof under this appropriation
shall begin at Beltsville and at Elkridge and such portion as
may be built through the town of Elkridge shall be upon the
bed of the old Washington and Baltimore Turnpike Road and
at the same grade as the said road is at present constituted.
SEC. 2. And be it enacted., That all acts or parts of acts
inconsistent with the provisions hereof are hereby repealed, it
being the intention of this act to supercede those portions of
the original act for the construction of State Road No. 1 which
conflict with the provisions hereof.
SEC. 3. And be it enacted, That this act shall take effect
from the date of its passage.

CHAPTER 374.
AN ACT to amend Article 91 of the Public General Laws of
Maryland, title "Surveyor and State Survey," by adding a
section under the sub-title "Public Roads," prohibiting the
use of wheels or devices upon the same injurious to the sur-
face of roads and highways.
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Article 91 of the Annotated Code of Public Civil
Laws of Maryland, title "Surveyor and State Survey," be
amended by adding a section under the sub-title "Public
Roads," to be designated as section 37A, and to read as follows:
37A. No person shall operate upon any of the public roads
or highways of this State, or of any county therein, any vehicle
so constructed or equipped as to cause any unusual amount of
damage to such highways; and no wagon, truck, road engine,
traction engine or other vehicle having metal tires or treads
shall be operated over or upon any such road or highway having
upon the wheels any clamps, spikes, ribs or other devices which
may cut into or injure the road surface, nor shall any wagon
or other vehicle of any kind be operated with a rough lock or
similar device under one or more of the wheels thereof in such
a manner as to cut into or injure the surface of any such road
