380 LAWS OF MARYLAND. [Ch. 193]

CHAPTER 193.

AN ACT to authorize and empower the Mayor and City Coun-
cil of Cumberland to close Creek street, between South
Mechanics street and Mill's Creek, in the City of Cumber-
land, and any other street or alley which lies between said
Creek street on the north and the north side of Howard
street on the south, between South Mechanics street on the
east and Mill's Creek on the west, in said city, and to
empower commissioners to award compensation to any per-
son or persons owning property on said public streets or
alleys, which may be closed, who may be affected thereby.

WHEREAS, The Western Maryland Railway Company, in order
to provide sufficient freight and traffic facilities and a site
for its new depot station in the City of Cumberland, is now
proceeding to acquire all the property lying on Creek street,
between the west side of South Mechanics street and Mill's
Creek in the City of Cumberland, and other property lying
south of the same between Creek street and Howard street,
whereby said portion of Creek street and any other parts of
public streets or alleys within said territory will no longer
be needed for the use of the public, but will be occupied by
the new station-house and the new freight buildings, freight
yards and railroad tracks of said railway company; there-
fore,

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That the Mayor and City Council of Cumberland be and
they are hereby authorized and empowered to close all that part
of Creek street lying between the west side of South Mechanic
street and Mill's Creek, and any other parts of public streets
or alleys lying between said Creek street on the north and the
northerly side of Howard street on the south, between the west
side of said South Mechanics street and Mill's Creek, and to
provide for ascertaining whether any and what amount in
value of damages will be caused thereby to the owner or pos-
sessor of any property lying on or through which said streets or
alley-ways may pass, which ought to be compensated by the
appointment of commissioners to assess the same as provided
in section 66 of Article 1 of the Code of Public Local Laws of
Maryland, entitled "Allegany County," sub-title "Cumber-
land," and from time to time to enact all necessary ordinances
