1556 LAWS OF MARYLAND. [Ch. 790]

bids; materials subject to
approval of road superin-
tendent; commissioners
shall purchase appliances
required for road construc-
tion; commissioners may
make rules for the care
and use of roads; shall im-
pose penalties for violating
such rules; rules to be re-
corded in book; to have
force of municipal ordi-
nances; may apply for in-
junction to enforce rule;
pleadings; affidavits; bond
of contractors.
457. Appointment of road super-
intendent; salary; term of
office; expenses; duties;
report to be made by su-
perintendent.
458. Owners of property may pe-
tition for improvement of
roads; deposit for surveys;
three examiners to be ap-
pointed; to determine what
amount to be paid from
the county; what may not
be closed; determine boun-
daries; assessment to be a
tax upon property; may be
collected as ordinary tax
or by a bill in equity.
459. Dedication of streets and al-
leys; county commission-
ers may accept; width of
such streets; plat to be re-
corded with deed.
460. Roads used fox twenty
years; powers of county
commissioners over.
461. County surveyor to snirvey
such roads; plat to be
deemed prima facie cor-
rect.
462. Commissioners may open or
close streets; may condemn
land; may appoint exami-
ners for opening roads;
may assess damages and
benefits; proceedings with
regard to such assessment.
463. Appeals from awards or as-
sessment; assessment to be
a lien; drains may be pro-
vided for.
464. Road heretofore dedicated;
right of drainage also to
be dedicated.
465. Commissioners may change
grade of road where it

crosses rallraods, etc.; spe-
cial assessment therefor.
466. Payment of such special as-
sessment.
467. Commissioners to have con-
trol of sewers, drains, etc.;
may lay out and construct
same, and assess benefits.
468. May connect sewers with
sewer system of the Dis-
trict of Columbia; expense
of same; how tp be met.
469. Commissioners to control
connections with sewers.
470. When commissioners cannot
agree with owners for land
or materials; may con-
demn.
471. Timber, etc., ,on property
dedicated, property of the
commissioners.
472. Right of appeal to the Cir-
cuit Court.
473. Proceedings not to be
quashed for formal de-
fects; jury trial.
474. Subpoenas for witnesses;
oath of witness; perjury.
475. Notice; how served; consta-
ble failing to serve or
making the false return.
476. Application for franchise in
relation to highways; how
made.
477. Granting of franchise.
478. Municipal control to be re-
served.
479. Franchise not to affect pri-
vate rights of adjoining
owners.
480. Moneys received by county
commissioners under this
sub-title to be applied to
general road and bridge
account.
