1508 LAWS OF MARYLAND. [Ch. 790]

the laws of the State, within the limits of said town. He, as
well as all other town officials, shall be liable to presentment
and indictment in the Circuit Court for Montgomery County
in their official capacity, and upon conviction shall be liable to
fine or imprisonment, or both, in the discretion of the court.

544. That the Mayor, the other members of the Council,
and all other officers of the corporation shall, before they enter
upon the duties of their respective offices, take and subscribe an
oath according to provisions of sections 5 and 7 of Article 70 of
the Code of Public General Laws, that they will support the
Constitution of Maryland and of the United States, and will
faithfully and diligently perform the duties of their respective
offices without favor, partiality or prejudice, and said oath shall
be filed among the records of the corporation.

545. That the clerk and treasurer shall give bond in such
penalties and with such surety or sureties as the Council shall
require., conditioned for the faithful performance of the duties
of the office. In case any person appointed as clerk and treas-
urer shall fail to execute the bond required within ten days
after the appointment and before taking the oath of office, the
said office shall be declared by the Mayor to be vacant, and he
shall at once proceed to fill the same by the appointment of
another person for the residue of the term, who shall qualify as
aforesaid.

546. That the Council shall receive all returns of elections
and determine all questions arising thereunder, but any person
considering himself aggrieved by any decision of the Council
under this section may appeal within ten days therefrom to the
Circuit Court of Montgomery County, which court shall hear
and determine such appeal and decide who shall pay the costs
thereof.

547. That the Council is hereby authorized to prepare a
plat of said town, upon which shall be shown all streets, roads
and public ways, whether projected or already laid out, and by
which all lots and real property in said town may be thereafter
described, said plat to be prepared and recorded in plat books
in the office of the clerk of the Circuit Court for Montgomery
County and of the county surveyor of said county, in the same
manner as required by sections 399, 400 and 401 of this act,
relating to the recording of plats, to control the subdivision of
