or some safe depository. When any officer wilfully fails to dis-
charge any duty of -his office, he may, in addition to the remedy
on his bond, be fined by the Mayor, at his discretion, not exceed-
ing ten ($10) dollars for any one offense, and for the payment
of such fine his bond shall be responsible. Any officer may be
dismissed by the council at its discretion.

218. The council shall receive all election returns, and
within ten days after said election, shall declare the result
thereof. They shall determine all questions arising thereon,
and any person conceiving himself aggrieved by reason of such
decision, may appeal to the Circuit Court for Montgomery
County which shall hear and determine the same, and determine
who shall pay the costs of appeal. In case candidates for
Mayor shall receive a tie vote, or two or more candidates for
councilmen shall receive the same number of votes necessary
to entitle any one of them to an election, a special election shall
be had as between those candidates receiving such tie vote after
ten days' notice shall have been given, pursuant to the pro-
visions foregoing in regard to elections; in case of any vacancy
in the office of the Mayor or councilmen by death, resignation
or removal from the town, said vacancy shall be filled by a vote
of the council until the next election for members of the council.

219. That the council shall have power to pass all ordi-
nances necessary for the good government of the town; pre-
vent, remove and abate or cause to be removed and abated all
nuisances or obstructions in or upon streets, sidewalks, high-
ways or alleys, drains, sewers, or water courses, or in or upon
any lot or lots adjacent thereto; to provide for imposing a fine
or fines upon any person or persons causing, creating' or main-
taining any such nuisances or obstructions; to remove, or cause
to be removed, houses or other obstructions or objects that limy
be dangerous to property, health or persons passing along or
over the highways of the town, or residing in the neighborhood
thereof; to make reasonable regulations in regard to buildings
to be erected in said town, and to grant building permits for
the same; to establish the grades of the streets, gutters and
sidewalks of said town, fix the width thereof and prescribe the
material of which they shall be constructed; to cause the side
walks along the public streets to be graded, paved, repaired or
improved; to cause the water courses, drains and sewers to bo
laid, paved, kept in repair and cleaned; to purchase, lease or
receive such real and personal property as may be necessary
or proper for municipal purposes and to control, dispose of
