the said Mayor and City Council shall originate before one of
said Justices of the Peace.

SEC. 220. The Justices of the Peace, in default of the
payment of any fine or penalty imposed by him for a viola-
tion of any ordinance of the said Mayor and City Council,
may commit the party fined as provided in section 217, and
in all such proceedings the bailiffs shall have the same powers,
proceed in the same manner, and receive the same fees as
constables in like cases. And all process shall be returnable
before some Justice of the Peace for Prince George's County
resident in the said town, upon the making of an affidavit
before the Justice to whom said process is returned that the
affiant believes a fair trial cannot be had before said Justice,
such affidavit must be made by the Mayor or by the accused in
person, as the case may be, with the right to the Mayor and
City Council, and to the defendant or accused, to remove any
case to another Justice of the Peace resident in the said town.
And in the event that there be no such Justice of the Peace
resident in the town, or in case of sickness, absence or disa-
bility of the said justice, the hearing of the oases or transac-
tion of business assigned to said justices by this charter, may
be had before some other Justice of the Peace in and for
Prince George's county and the Mayor and City Council may
provide for the expenses so incurred. And the said Justices
of the Peace resident in the said town shall report to the Mayor
and City Council monthly, on the second Monday of each
month, all cases in which the Mayor and City Council was a
party, showing the disposition of the same, and at the same
time remit all fines collected. And in all of said proceedings
before said Justice of the Peace, the defendant shall have the
right to appeal from the said Justice's decision to the Circuit
Court for Prince George's County, upon giving such bond or
entering into such recognizance as the said justice may require.

Bailiffs.

SEC. 221. There shall be appointed annually by the Mayor,
subject to confirmation of the City Council, on the fourth
Monday in April, or as soon thereafter as practicable, one
or more persons, not exceeding three, who shall be qualified
voters of said town, as herein defined, as bailiffs of said town,
whose duties it shall be to preserve the peace and good order
of the town, to arrest without warrant and take before a
Justice of the Peace any person found violating any ordinance,
resolution or regulation of the town or any law of this State;
or upon warrant issued on complaint of others to arrest any
