of the names of the litigants in the respective cases
at each term, the names or initials of attorneys on
the margin, and short notes of the dispositions
made. The original book containing the full rec-
ord of proceedings is extant. It is a thick folio of
845 closely written pages, marked "H.D. No. 1",
and while clear, is in imperfect, somewhat mutil-
ted condition. No other record devoted exclu-
sively to appellate proceedings before the Gov-
ernor and Council has been found, although there
are in existence copies of the lists of judges pres-
ent, indicating that original minutes at least were
kept. This one record leaves off the work in 1728,
when William Gumming was clerk, with a large
number of pages still unused. It contains copies
of writs and other papers, narrations of transac-
tions before the court, votes of judges, various
judicial orders, and opinions of the bar furnished
to the court at its request;12 and it gives verbatim
some colloquies between the court and counsel.
And on an extra page after the index, the clerk
inscribed his schedule of fees:
To the Clerk of the High Court of Appeals
To recording every writ of Error Scire Facias and
Return per Side..................................................... 24 tobo.
And so pro rato as before seven words in a line
and twelve lines in a sheet. The like for re-
cording a transcript. The like fees for record-
ing the errors.

All other fees as taken in the Provl. Court Office.

the book shows, but they have been cut from the book.
