Sec.

commissioner of primary schools, they

   

shall draw upon the treasurer for their

   

proportion, to Be applied in payment of

   

teacher, &c.

MONTGOMERY CO. In case of any district failing

   

for two years to furnish a school house and

   

teacher, their proportion withheld and di-

   

vided amongst the districts that do furnish

To be reinstated however oh after-

   

wards complying.

Treasurer of the western shore directed

   

to deposite the school fund of, to the credit

   

of primary school commissioners of said

   

county, in the Farmers Bank of Mary-

   

land,

Said commissioners to distribute the

   

same on the 2d Monday in May and No-

   

vember annually,

Powers vested in the taxable inhabi-

   

tants of the school districts of, shall be

   

the same as vested in voters holding real

   

property in such school district,

School tax to be laid upon all property

   

usually taxed in said except property

   

owned by free negroes,

The inhabitants of any school district,

   

" so qualified, may vote a school tax, &c.

"

Where lands, but no personal property

   

of an individual be in such district, the

   

trustees of the school clothed, in relation

   

to such lands, with all the powers of com-

   

missioners of tax in any county of this

   

State, under the act of 1797, ch. 90, and

   

the collector with. all the powers of coun-

   

ty collector in like cases,

to be public and remedial acts, shall be

   

construed equitably and not with rigid

   

adherance to form,
