CRIMES AND PUNISH-

   

MENTS, If any person shall enter any dwelling

   

house, out house, &c. &c. or any building

   

occupied in part or in whole, by any pub-

   

lic municipal or private corporation, &c.

   

or upon any vessel, &c. or any yard where

   

any lumber, coal, or any sort of goods or

   

chattels are kept for the purpose of trade

   

&c., with intent maliciously to destroy,

   

&c. or to slay, kill, maim or tar and fea-

   

ther any person, being in or upon said

   

premises, &c. liable to confinment from

   

two to twenty years in the penitentiary,

Courts having jurisdiction of crimes

   

shall have cognisance of the foregoing

   

offences,

"

Judges of the several courts upon the

   

conviction, for criminal offence, of any

   

free negro or mulatto, shall enquire wheth-

   

er such negro, &c. had been previously

   

sentenced to the penitentiary in this State,

   

n ml if so, shall in their discretion order

   

the offender to be sold out of the limits of

   

the state for a term of years,

Proceeds of such sale, after paying ex-

   

penses of prosecution, shall be paid into

   

the public treasury,

One moity of all fines and forfeitures

   

adjudged &c., in Baltimore city court,

   

when, and as hereafter secured by the

   

sheriff, shall be paid to the mayor and

   

city council of the city of Baltimore,

Out of such funds the judges may di

   

rect to be paid to the Attorney General,

   

or his deputies, such additional fees, not

   

exceeding $30 in any one case, in cases

   

of extraordinary duration or trouble, as

   

they shall deem just and reasonable
