CHAPTER 316.

Passed April 2, 1836

An act, for founding a College, near Emmettsburg,

 

in Frederick County.

Preamble

WHEREAS, Thomas R. Butler and Edward J. Sou-

 

rin by their petition to this General Assembly, have set

 

forth, that they have been for many years associated

 

for the education of youth, the pursuit of science, and

 

the general diffusion of knowledge, and have prayed to

 

be incorporated:

Incorporated

SECTION 1. Be it enacted ly the General Assembly of

 

Maryland, That the said Thomas R, Butler, Edward

 

J. Sourin, and those who may hereafter become mem-

 

bers of the said association, and their successors, from

 

and immediately after the passage of this act, be, and

 

they are hereby created and declared to be a body po-

 

litic and corporate, by the name and style of the Pre-

 

sident and Council of Mount Saint Mary's College,

 

and by that name to have succession, and be able and

 

capable at law and in equity, to sue and be sued, im-

 

plead and be impleaded, in any of the Courts of this

State; and that it shall and may be lawful to and for

 

the said Thomas R. Butler, Edward J. Sourin, and

 

others, who may hereafter become members of the said

 

association, and their successors, to devise, make, have,

 

and use a common seal, and the same to break, alter

 

and renew at their pleasure; and to make, alter and

 

repeal rules and by-laws, not contrary to the Consti-

 

tution and laws of this State, for the good government

 

of said association; and the said association and their

 

successors, by the name and style aforesaid, are here-

 

by made, and shall be capable in law to purchase, take,

 

hold and convey in fee simple, or for any less estate,

any real or personal estate whatsoever; Provided, that

 

the said association shall at no one time hold and pos-

 

sess more than two thousand acres of land, and that

 

the yearly value of all the estate, real and personal, of
