mile, on all goods, merchandise, or property of any de-

 

scription whatsoever, transported on said rail road, or

 

any lateral ways which they may construct, and also

when any car shall be placed on said rail road, it be

 

adapted in size and all necessary particulars to said

of this State, may at any time hereafter, regulate, mo-

 

dify or change the control, vise and estate of so much

 

of the rail road as shall be constructed under the au-

 

thority hereby given, and be situate from Braddock's

 

Run, through the gorge of the mountains, to the basin

 

or the canal of the Chesapeake and Ohio canal com-

 

pany, at or near Cumberland, in such manner, as it

 

may deem equitable towards the said company, and ne-

 

cessary to the accommodation of the public travel, or

 

use of so much of the said rail voad.

Open books for subscription.

SEC. 4. And be it enacted, That the President and

 

Directors of the said Maryland Mining Company,

 

and William McMahon, John J. Hoffman and William

 

Houx, shall be and they are hereby authorized to open

 

books for subscription to the capital stock of a Bank,

 

to be called the Mineral Bank of Maryland, to he loca-

 

ted at Cumberland, in the county of Allegany, the

 

capital stock whereof shall be five hundred thousand

 

dollars, divided into fire thousand shares of one hun-

 

dred dollars each, which said books shall be opened in

 

the town of Cumberland, and at such other places in

 

this State or elsewhere, and under the direction of such

 

persons, as they may appoint, and to be kept open for

published in the respective places where said books
