CHAP. 89.

title of a purchaser, purchasing the estate mentioned in
said deed, after the date of said deed, without notice of
said deed; And provided, it shall not affect creditors trust-
ing said grantor after the date of said deed, and prior to
the time of recording it.

 

CHAPTER 89.

Passed Jan. 30, 1832

An act for the benefit of the heirs and creditors of George
Tilghman, late of Washington County, deceased — and
for other purposes.

Preamble.

WIIEUEAS, George Tilghman, late of Washington coun-
ty, deceased, died intestate, possessed of two tracts ot
land, in said county; one called the "Old Forge Farm," and
containing two hundred and sixty acres, more or less, which
the said Tilghman purchased, in fee simple, in the month of
December, eighteen hundred and thirty, from a certain Jo-
seph Martin and wife; the other situated upon the Potomac
river, adjoining lands of John R, Dall and Jacob Long,
and containing two hundred and ninety three acres,more or
less, which the said Tilghman purchased, in fee simple, in
the month of February, eighteen hundred and thirty one,
from a certain Thomas M'Cauley; And whereas, the said
Tilghman never received in his life time a deed for the
tract of land last mentioned; And whereas, it is deemed and
considered highly important and advantageous to the inter-
ests of the creditors and heirs of said deceased, that the said
lands should be sold, at as early a day as practicable, and
the proceeds of the sales applied to the benefit and relief of
the estate of said deceased; and to that end that suitable per-
sons be appointed trustees to receive a deed for the tract of
land purchased from Thomas McCauley, and to sell and
convey the aforesaid tracts of land — Therefore,

Persons authorised
to receive deed &c.
as Trustees.

Section 1. Be it enacted by the General Assembly of Ma-
ryland, That Frisby Tilghman, senior, and John R. Dall,
both of Washington county, be, and they are hereby ap-
pointed, authorised, and empowered to receive, in their
name, a good and sufficient deed, in fee simple, from the
person or persons required or authorised to give the same,
to be duly executed, acknowledged and recorded as the law
requires, for the tract of land purchased by the said George
Tilghman, from the said Thomas M'Cauley, as herein be-
fore stated and described, and to receive and take posses-
sion of the same; which said deed shall convey to the said
