or having made such collection, to pay the same over, or

account therefor, to appoint a trustee or trustees to make or

complete such collections, for the benefit of those concerned.

Sec. 2. And be it enacted, That the said courts, or any of
|

them, shall and may cause subpoena to be issued for any

tor &c, to answer.

or petition; and shall and may order and compel such col-

lector or sheriff, or deputy sheriff, or his representatives, to

answer any such bill or petition, under oath, and disclose
|

the true and actual state of his collection.
|
 
|
Sect. S. And be it enacted, That the said county court
|

shall have power to order the delivery to said trustee or
|
empowered to or-
der the delivery of

trustees by any person or persons whomsoever, of all books,
|
bocks, papers &c.
|
papers, and vouchers, of, or in any wise concerning the
|
 
|
claims, demands, and debts, to be collected as aforesaid; and
|
 
|
the disclosure, on oath, by such collector, sheriff, or deputy
|
 
|
sheriff, their executor or administrators, of all the books,
|
 
|
papers, and vouchers aforesaid, and the place of deposit of
|
 
|
the same, and the persons having control custody or posses-
|
 
|
sion of the same; and to enforce the execution of such order
|
 
|
by attachment, or otherwise, as is practised in Chancery,
|
 
|
for enforcing performance of its orders; and said county
|

court may, in general, pass all orders, and enforce them as

aforesaid, that may be deemed necessary for furthering and
|
 
|
effecting the collection aforesaid.

Sec. 4. And be it enacted, That the trustee or trustees

Sec. 5. And be it enacted. That the provisions of this act

pear to the county court as aforesaid, that they have suffer-
|

ed or are in danger of suffering from such liability as secu-
|
 
|
rity or securities; Provided however, That in such cases the
|

county court shall not be empowered to grant relief as afore-
|
 
|
said, unless the application as aforesaid, be made within six
|
 
|
years after the death, or the end of the term or period of
|
 
|
office as aforesaid; except so far as to appoint a trustee or
|
 
|
trustees, as aforesaid, with power to collect the claims, de-
|
 
|
mands, and debts, as aforesaid, in the mode ordinarily law-
|
 
|
ful for recovering debts.
