Upon the affirmance of certain
judgments, to return the tran-
script of the record, with a writ
of procedendo, to the county
court, commanding; them to pro-
ceed in such action to a new tri-
al in the same manner as if no
trial had taken place, or any ap-
peal had, or writ of error brought,
, &c. and the opinion of the court
of appeals to be conclusive in law
as to the question by them de-
cided, in all cases of appeals upon
any question of location of land,
where the judgment shall be af-
firmed or reversed, and it shall
become necessary for the purpo-
ses of justice to remand the cause
to the county court which gave
the judgment, with a writ of pi o-
cedendo, it shall be the duty of
the court of appeals to instruct
the county court as to the manner
in which the said location shall be

to an act, entitled, An act con-
cerning crimes and punishments
Any person who shall be com-
mitted for nonpayment of any
penalty or forfeiture, not ex-
ceeding fifty dollars, who shall
have remained in custody for the
space of thirty days, or who shall
be committed to jail for nonpay-
ment of any penalty, &c. above
fifty dollars, and not exceeding
one hundred dollars, who shall
have remained in custody for the
space of sixty days, shall be dis-
charged from further imprison-
ment for said penalty or forfei-
ture and the costs; provided
such person shall prove to the
satisfaction of the court imposing
said penalty or forfeiture, that ho
