in the said managers, or for the performance of the duties
required of them bv this act, and the said by-laws from
time to time to alter and repeal; subject nevertheless to the
revision of the stockholders at a general meeting as is here-
in before provided.

Powers.

Sec. 8. And be it enacted,That the said company are
hereby invested with all the rights nd powers necessary
to the construction of a turnpike road from the city of
Frederick, Frederick county, to Mechanic's-Town, and
thence to Emmitsburg. and from thence to intersect the
Pennsylvania line at the nearest point on the route to Get-

tysburg; Provided, that the company may use the bed of
the road now leading from Frederick city to the town of
Emmitsburg, and from thence to the Pennsylvania line, on
the route to Gettysburg, or so much thereof as they may
find necessary, with the consent in writing of a majority
of the levy court of Frederick county, at one of their
meetings for public business.

Sec. 9. And be it enacted. That the president and ma-
nagers of said company mav agree with the owners of laud
for the purchase of land required for said road, and also
for the purchase of stone, gravel, earth and sand, for said
road, and \n all cases where they are unable to agree with
the owners, or the owner should he a feme covert or non
compos mentis, or under age, the said president may apply
to a jus! ice of the county aforesaid, which justice shall
thereupon issue his warrant to the sheriff of said county,
commanding him to summon twenty disinterested persons,
qualified to act as jurors in the county court, to meet upon
the land; after four are stricken off; he pannel by the presi-
dent or his agent, and tour by the person or persons inte-
rested, or in his, her or their absence or refusal, by the s ;id
sheriff, the sad sheriff shall quality the twelve remaining
persons, either bv oath, or affirmation, as the case may he,
justly, truly and impartially, to value the damasks which
may be sustained bv the owner or owners of such materi-
als or land required by the said company, and the said ju-
rors shall, after valuing said damages, return the same, un-
der their hands and seals, to the clerk of Frederick county
court, to be by him recorded, and said damages shall he
paid by the company into the hands of the sheriff of the
said county, for the persons mentioned in said return re-
spectively, before the said company shall proceed to re-
move said materials, or to use the said land for said road;
and the justice, sheriff and clerk, shall he entitled to re-
ceive the same fees for services under this yet as thev nre
allowed in similar cases and the person s summoned as ju-
rors shall each receive one dollar per day during their at-
