spective counties, shall have full power to allow or reject
all claims for appointment of expense in making repairs
or improvements, as they may deem proper, having at all
times a due regard to all the circumstances of the cases be-
fore them, and provided, that no allowance or apportion-
ment of any such expenses under this act, shall be made,
unless the said repairs or improvement shall have been
first authorised and directed by the orphans court of the
county where the case may arise or accrue.

Right of ap-
peal.

Sec 4. And be it enacted, That if any person, or the
guardian of any person, may conceive him or herself ag-
grieved by the decision of any orphans court under the
provisions of this act, he or she may appeal to the county
court, and a transcript of the proceedings shall be sent to
the said county court, who shall bear and examine the
same, and give such judgment in the matter, as may be
according to right and equity.

A Further Supplement to an act, entitled, An act for
the distribution of a certain Fund for the purpose,
of establishing Free Schools in the several Counties
therein mentioned.

Powers vested
in the orphans
court of So-
merset.
|
Section 1. Be it enacted by the General Assembly of
Maryland, That until the assignment and appropriation
ot funds for the support and maintenance of public instruc-
tion, as provided by the act of December session eighteen
hundred and twenty-five, chapter one hundred and sixty-
two, the justices of the orphans court of Somerset county
be, and they are hereby substituted and appointed in place
of the commissioners of the school fund heretofore appoint-
ed; and the said orphans court are hereby vested with all
the powers and authorities which the said commissioners
were vested with by the act to which this is a supplement,
and that they have full power to appoint trustees for the
distribution of the school fund in the several election dis-
tricts of said county.
