where necessary, and to have the same kept in re-

pair, and to have erected and kept in repair at the
|
 
|
forks and crossings posts and guide-boards with
|
 
|
plain letters for guide, giving the directions and dis-
|
 
|
tances to the most noted places to which said roads
|
 
|
lead.
|
 
|
SEC. 5. And be it enacted, That all the public roads
|
 
|
in said county shall be mended and kept in good
|

owner or tenant, through which such road shall pass
|
 
|
or bind on ; and whenever any public road, or any
|
 
|
bridge or culvert shall be out of repair, or said road
|

shall be obstructed in any manner, it shall be the
|
 
|
duty of the supervisor to have such road, bridges or
|
 
|
culverts repaired, and such obstructions removed by
|
 
|
the person or persons whose duty it shall be to keep
|
 
|
that part of the road in repair ; provided, that the
|

cost of such bridge or culvert shall not exceed twenty-
|
 
|
five dollars, in which case he shall report the same
|
 
|
to the county commissioners, whose duty it shall be
|
 
|
immediately to give such instructions to said super-
|
 
|
visor as shall authorize him to have such bridge or
|
 
|
culvert rebuilt or repaired, as the case may be ; and
|
 
|
all the work done on, and materials furnished and
|
 
|
provided for the use of the public roads, shall be ex-
|
 
|
amined by the supervisor for such road, and, if ap-
|
 
|
proved of, estimated and valued by him, and the
|
 
|
bills for the same certified by him to the county-
|

commissioners, and, on the order of the commis-

sioners, the same shall be paid out of the funds of
|
 
|
the county, and shall be receivable after such order
|

in payment of county taxes or any other dues to the
|

county.

SEC. 6. And be it enacted, That it shall be competent
for the supervisor, in his discretion, whenever he
|

shall be satisfied that any of the owners or occupy-

ers of land, whose duty it would be, under this law,
|
 
|
to keep such roads in good repair, cannot perform
|
 
|
such duty, or ought to be excused from the same, to
|
 
|
authorize and empower, at the request of such per-
|
 
|
son, some occupier or owner of adjacent lands to
|
 
|
perform such duty on the same terms as the original
|
 
|
party would have been required to perform the
|
 
|
same.
