the appointment of a commission to take testimony,

re enacted and
extended.

to provide for the recording of copies of wills and
|
 
|
other papers, of which the originals were lost by the
|
 
|
burning of the court-house in Dorchester county,
|
 
|
and to remedy, as far as practicable, the evils likely
|
 
|
to ensue from the destruction of the recorSs of said
|
 
|
county,' " reviving and re-enacting said act, except
|
 
|
the second, third, fourth, fifth, sixth, seventh, eighth,
|
 
|
ninth, fifteenth, nineteenth, twentieth, twenty-first,
|
 
|
twenty-fourth and twenty-fifth sections thereof, be
|
 
|
and the same is hereby revived, re-enacted and ex-
|
 
|
tended to read as follows :
|
 
|
2. The judges of the orphans' court of said county
|
 
|
be and they are hereby authorized and empowered
|

to appoint some suitable person a commissioner to
|

perform the duties prescribed by the aforesaid pro-
|
 
|
visions of said act herein re-enacted, and by the pro-
|
 
|
visions of this act ; and the said commissioner, before
|
 
|
he proceeds to act as such, shall take and subscribe,
|
 
|
before the clerk of the circuit court of said county,
|
 
|
the oath required by the Constitution of this State;
|

and in case of the death, resignation, removal from
|
 
|
the county, or other disqualification of the said com-
|
 
|
missioner, the judges of the orphans' court aforesaid
|
 
|
shall till the vacancy ; and the said commissioner shall
|
 
|
receive such compensation, not exceeding twenty dol-
|
 
|
lars in each case, as the county commissioners of said
|
 
|
county shall allow, to be paid to him by the treasurer
|
 
|
of said county upon the order of said commis-
|
 
|
sioners.
|
 
|
3. The said commissioner shall, at the expense of
|
 
|
said county, provide himself with a suitable book,
|

and such stationery and blanks as may be required ;

and in said book he shall keep a fair record of each
|
 
|
and every case brought before him, and of all the
|
 
|
papers, testimony and proceedings therein ; and upon
|
 
|
the completion of his duties as commissioner, shall
|

deposit said book in the office of the Register of
|
 
|
Wills of said county, to be kept as other record
|
 
|
books therein.
