CHAPTER 202.

 

AN ACT to repeal section sixteen of chapter four

 

hundred and seventy-six, passed at the January

 

session eighteen hundred and seventy, entitled

 

"an act to provide for the creation and regulation

 

of incorporated companies in the State of Mary-

 

land," and to re-enact the same so as to read as

 

follows:

 

SECTION 1. And be it enacted by the General Assembly of

 

Maryland, That section sixteen of chapter four hun-

 

dred and seventy-six, passed at the January session,

 

eighteen hundred and seventy, entitled " an act to

provide for the creation and regulation of incorpo-

rated companies in the State of Maryland," be and

 

the same is hereby repealed, and the said sixteenth

 

section be re-enacted to read as follows :

 

SEC. 16. And be it enacted, That it shall be lawful

for such corporations, whenever it may be necessary

 

in the construction of such road to cross any road

 

or stream of water, to divert the same from its pres-

 

ent location or bed, provided it is not a navigable

 

stream; and it shall be lawful for such corporation

 

or for any railroad corporation, heretofore incorpo-

 

rated under any general or any special law, whose

 

railroad now crosses or may hereafter cross any pub-

 

lic or private road, to carry said road over its track

 

or tracks by a bridge, or to carry it under its track

 

or tracks by an under crossing And to make such

 

crossings, said corporation may divert said road from

 

its present location ; and for entering or taking any

poration may proceed as in case of land necessary

 

for its railroad under the powers given it by law ; but

 

said corporations shall, without unnecessary delay,

 

place such road or stream in such condition as to

 

not impair its former usefulness ; and provided such

 

corporations shall be liable for damage caused by

 

such diversion of any stream.

 

SEC. 2. And be it enacted, That this act shall take
