who shall give bond to said commissioners, for the

 

faithful discharge of his duties in such penalties as

 

the commissioners shall require, whose duty it shall

 

be to preserve the peace and good order of said town,

 

and for this purpose he is hereby vested with the same

 

power and authority as a constable, and shall have

 

the same fees as constables receive for similar services.

Take oath

SEC. 14. And be it enacted, That the said commis-

 

sioners, and all other officers of the corporation shall,

 

before entering upon the duties of their respective

 

offices, take an oath, before a justice of the peace,

 

that they Will diligently and faithfully, to the best

 

of their judgment and ability, discharge the duties

 

of the office without favor, partiality or prejudice.

Open streets.

SEC. 15. And be it enacted, That the commissioners

 

may pass such ordinances, not contrary to law, as

 

they may deem beneficial to the town, may open and

 

close, straighten, widen, and improve streets, grade

 

and pave the same ; make causeways, establish the

 

width and grade of sidewalks, curb, pave and set out

 

shade trees therein.

SEC. 16. And be it enacted, That on the same day

this act, and on the first Monday of each and every

 

y ear thereafter, one person possessing the qualifica-

 

tions required for a commissioner, shall be elected

 

treasurer of said corporation, who shall keep an ac-

 

count of the receipts and disbursements of the funds

 

of the corporation, and annually render to the com-

 

missioners an account thereof, but before said treas-

 

urer shall enter upon the duties of his office he shall

penalty as they may fix, with securities to be ap-

 

proved by them, conditioned that he will well and

 

laithfully account for all moneys paid over to him by

 

the bailiff of said town, or any other person or per-

 

sons for the use and benefit of said town, that he

 

will well and faithfully account for all taxes collected

 

by him, and shall also well and truly pay to the order

 

of said commissioners or a majority of them all sums

 

of money, received by him, and the said bond shall

 

be recorded by the clerk among the records of said
