hogs, or any kind of cattle, belonging to any other person
or persons, or cause the same to be done, shall make good
all such damages sustained thereby to the owner or own-
ers thereof, as shall be awarded by two respectable disin-
terested men of the \icinity, under their oath or affirma-
tion, who may be summoned to view the same, and in case
of their disagreement, it shall be lawful for the party or par-

ties aggrieved, to cause a third man to be summoned, who
shall qualify as above required, and the decision of any
two of them shall be final, the said damage's to be reco-
vered in the same manner as is, or, shall be prescribed for
the recovery of small debts.

Sec. 4. And be it enacted, That each freeholder, who
shall be called on to value and assess the damages, shall
be allowed for his services, fifty cents per day; the fees of
officers for duties performed under this act, shall be the
same as allowed by law, for duties of the like in cases of
debt.
Sec. 5. And be it enacted, That all laws or parts of laws,
inconsistent with or repugnant to the provisions of this
act, so far as the same relates to Kent county, be and the
, same are hereby repealed.

An act to incorporate, the town of Franklin in Baltimore
county..

|
SECTION 1. Be it enacted by the General Assembly of
Maryland, That the citizens of the town of Franklin,
in Baltimore county, shall be and they are hereby consti-
tuted and made a body corporate, by the name of the Com-
missioners of the town of Franklin, with all the priviliges
of a body corporate, and to have a common seal and per-
petual succession.

Sec. 2. And be it enacted, That the free male white ci-
tizens of the town of Franklin, aforesaid, of the age of
twenty-one years, and upwards, and who have resided in
the said place, for, and during the space of six months,
next preceding the election, shall on the first Monday in
May next, at the house, now known as the Franklin House
Hotel, and on the first Monday in June, in each and every
