1833.

Sec. 5. And be it enacted, That the guardian of an in-
fant owner, shall have full power and authority on behalf
of his ward, to make application for repaving under the
provisions of this act.

Sec, 6. And be it enacted, That the Mayor and City
Council Of Baltimore, shall have full power and authority,
to pass any ordinance or ordinances, necessary and proper
to carry into effect the object of this act.

CHAPTER 41.

 

An act supplementary to an act passed at December session,
1331, chapter 244.

Passed Feb. 10, 1334

SECTION 1. Be it enacted by the General Assembly of
Maryland, That whenever any one or more of the trustees
selected under the provisions of the fourth act, to which
this is a supplement, shall die, resign or remove from the
district, it shall and may be lawful for the remaining trus-
tees to supply such vacancy at any subsequent meeting of

Sec. 2. And be it further enacted, That in all esses where
a school has been located by the commissioners appointed
by the act to which this is a supplement, and the trustees
not having complied with the said act, that it shall and
may be lawful, and is hereby made the duty of the Orphan's
court in Caroline county to equally divide the amount
which the election district may be entitled to among the
schools that have complied with the provisions of the ori-
ginal law; and that the said schools in the different elec-
tion districts of said county shall be entitled to continue to
receive the whole amount allowed to said election district,
until those not yet organized may become entitled, by a
compliance with the provisions of this act, or the act to

Sec. 3. And be it further enacted, That in case the
schools, or any one of them now in operation, and which
is claiming and receiving as by the original act, they are
entitled to do, should fail or fall through, then it shall be
lawful for the Orphan's court to divide equally the funds
between the district schools still in operation in the elec-
tion district.
