CHAP. 32

shall pay to die overseer of his hundred, the sum of seven-
ty-five cents, for each and every day so refusing or neglect-
ing, to be recovered by1 the said overseer, by judgment of
any justice of the peace of said county, in the manner now
provided by law, for the recovery of other small debts, and
to be applied by the said overseer to the repairs of the
aforesaid roads in his hundred.

Overseer's salary

Sec. 4. And be it enacted, That each overseer of the pub-
lic roads to be appointed by virtue of this act, shall be al-
lowed by the commissioners aforesaid in full compensation
for his services the sum of sixteen dollars annually.

Remedy for Over,
seer's neglect

Sec. 5. And be it enacted, That in any case of any com-
plaint to the commissioners aforesaid, against any of the
overseers of the public roads aforesaid, charging any one
of the said overseers with neglect or remissness in the exe-
cution of his duty, the said commissioners shall forthwith en-
quire into the same; and if it shall be made appear to the
satisfaction of said commissioners or a majority of them,
that said complaint or charge is just and well founded,
then the said commissioners shall have power, and they
are hereby authorised and required to deduct from the com-
pensation allowed to the said overseer, such sum as to
them shall seem just and proportionate to the degree of re-
missness or neglect, not exceeding debt dollars for any
single offence, which sum so deducted snail be retained by
the collector, subject to the future disposition by said com-
missioners for county purposes.

Only owners of cart

and horse liable

Sec. 6. And be it enacted, That no person who does
not own a cart or horse, shall be compelled to work on the
said roads; and that all laws repugnant to, or inconsistent

Repealing clause

with the provisions of this act, be and the same are here-
by repealed, so far as the same relates to Calvert county.

Passed Feb. 7, 1834

An act for the relief of Samuel P. Smith and Reuben Wor-
thington, of Allegany county.

Preamble

WHEREAS, it is represented by the petition of Samuel
P. Smith and Reuben Worthington, that they are owners
of lot one hundred and ninety-six, in the Town of Cumber-
Iand, and that the buildings on said lot were consumed by
