LAWS OF MARYLAND.

CHAP. 176,

hereby vested with all the powers and duties necessary to
carry into effect the objects of this supplementary act, in
the manner hereinafter stated.

Oath required

Sec. 2. And be it enacted, That the said commissioners
shall within one month after the passage of this act, make
oath or affirmation before some justice of the peace in the
city of Baltimore, that they will faithfully execute the du-
ties assigned to them by this act, to the best of their ability,
and without favour, affection or partiality, and should any

of said commissioners refuse or neglect to take such oath,
or affirmation, within the time aforesaid, he or they shall
be considered as having resigned, and the remaining com-
missioners who shall have taken said oath or affirmation,
if they be a majority of the whole, shall be authorised to
execute this law in like manner as if they alone were nam-
ed in this law, or if they be not a majority of the whole,
those who qualify as aforesaid, shall be and they are here-
by authorised and required to appoint persons to supply the
vacancy, or vacancies in the said board, who shall within
ten days thereafter, also make the oath or affirmation
aforesaid.

Sec. 3. And be it enacted, That said commissioners af-
ter having given ten days notice in two of the daily news-
papers in the city of Baltimore, of the time and place of

their meeting, shall proceed to assess the whole damages
and expenses consequent upon the opening and increasing
the width of German Lane, in the title of this act mention-
ed, as the same have been already ascertained by the com-
missioners heretofore appointed as aforesaid, under and
by virtue of the original act to which this is a supplement;
adding thereto whatever expenses may be incurred under
this supplement, upon all the property in the city afore-
said, which in the opinion of the commissioners hereby ap-

pointed, having regard to all circumstances, may be deem-
ed benefitted by the widening and opening et the afore-

said lane; Provided however, that no part of the damages
or expenses aforesaid, shall be assessed upon any Church,
Meeting House, Lecture or Session Room, or other place
of public worship, or any public or free school, or burying
grounds belonging to any Church, Congregation, or Reli-
gious Society.

Report required

Sec. 4. And be it enacted, That the said commissioners
having completed said assessment, shall make a full and
particular return thereof, under their hands and seals, to
the office of the register of the city aforesaid, designating
