with a certificate of the qualification, which may be ratified or
|
 
|
rejected, or altered or amended, in whole or in part, by the
|
 
|
Commissioners of Leonardtown. The said Commissioners shall
|
 
|
pay or tender to the person, his agent, guardian or representa-
|
 
|
tive, the amount of damages so awarded by them, and if any
|
 
|
one should feel aggrieved by the decision of the Commission-
|
 
|
ers, who is in any manner affected by their decision, he may
|
 
|
appeal to the Circuit Court for St. Mary's County, by giving
|
 
|
written notice within twenty days from said decision, filed with
|
 
|
the treasurer of said Commissioners, of his desire to appeal ;
|
 
|
and on the filing of said notice the Commissioners shall cause
|
 
|
to be delivered the papers connected therewith to the Clerk of
|
 
|
said court, and the same proceedings shall be had on the ap-
|
 
|
peal as in cases of appeal from judgments of justices of the
|
 
|
peace ; provided, nevertheless, that "The Commissioners of
|
 
|
Leonardtown" may decline to open, lay out, extend, widen.
|
 
|
grade or straighten any street, alley, or highway, or any square,
|
 
|
waterway, or drain, notwithstanding the decision of said court ;
|
 
|
but, in case of refusal to do so, they shall be liable for all
|
 
|
costs incurred, and shall pay the same. On appeal the
|

be collected by action at law.

Bailiff.
|
 
|
 
|
70. That said Commissioners may annually appoint one or
|
 
|
more active and discreet persons to act as bailiff within the
|
 
|
corporate limits of said town, who, before he proceeds to act
|
 
|
as such, shall make oath, to be administered by a justice of the
|
 
|
peace for St. Mary's County, that he will faithfully and impar-
|
 
|
tially perform the duties required of him as bailiff, without
|
 
|
favor or affection, according to the best of his skill and judg-
|
 
|
ment, and he shall execute a bond with sureties, to be approved
|
 
|
by the Commissioners in such penalty as they may require, for
|
 
|
the faithful performance of his duties as town bailiff. The
|
 
|
said bailiff shall have, within the corporate limits of "The Com-
|
 
|
missioners of Leonardtown," all the powers held and exercised
|
 
|
by the constables of this State ; he shall attend the meetings of
|
 
|
the said Commissioncrs,when notified by them to do so, and shall
|
 
|
perform such services and duties as are or shall be imposed upon
|
 
|
him by law, ordinance or by order of the Commissioners; he
|
 
|
shall arrest and take before some justice of the peace in St.
|
 
|
Mary's County, to be dealt with according to the laws of Mary-
|
 
|
land or the ordinances passed by "The Commissioners of
|
 
|
Leonardtown;" any person found violating any of the lawrs of
|
 
|
Maryland, or any of the ordinances made or passed by "The
|
 
|
Commissioners of Leonardtown," within the corporate limits
|
 
|
of said town, and any one resisting said bailiff in the discharge
