and duties, as are vested in, or required of, any three or more of the
justices,
out of court, by virtue of the said act; and the said chief justice,
or any one of
the said associate justices, out of court, shall have, possess and
execute, the same
jurisdiction, power and duties, as are vested or required of any one
justice, out
of court, by virtue of the said act; and in case of the death, refusal,
resignation,
or removal out of the said county, of the said chief justice, or either
of the
said associate justices, a new commission shall issue to fill up such
vacancy. |

holding court
altered, &c. |
III. And be
it enacted, That the time directed by the said act for holding the
said court on the second Tuesday of November, shall be altered, and
the said
court shall be hereafter held on the third Tuesday of November, annually,
during
the continuance of this act. |
Allowance to
chief justice,
&c. |
IV. And be it
enacted, That there shall be allowed to the said chief justice,
as a compensation for his services in executing of all the duties required
by this
act and the said act for the more effectual punishment of criminals,
at the rate of
two hundred pounds current money per year during the time he
shall act as chief
justice of the said court, and the said sum shall be annually assessed,
by the justices
appointed by virtue of this act, on Baltimore county, and shall be
paid by the
collector to the said chief justice in the manner directed by the act
for the better
administration of justice in the several counties of this state, and,
in default of
payment, recovered in the same summary way provided and directed by
the
seventeenth section of the said last mentioned act for the recovery
of the allowance
given by the said act to the chief justice appointed in virtue thereof;
and each
associate justice appointed and commissioned in virtue of this act
shall receive, as
a compensation for his services, the sum of ten shillings current money
for every
day he shall attend in court, and the said allowance shall be assessed
by the said
justices to Baltimore county. |

CHAP. LI.
An ACT to repeal an act, entitled, An act to ascertain the allowance
to the members of the general assembly, and to defray
the
expences of their attendance. |
An act repealed. |
BE it enacted,
by
the General Assembly of Maryland, That an act passed in
April session, one thousand seven hundred and eighty-seven, entitled,
An
act to ascertain the allowance to the members of the general assembly,
and
to defray the expences of their attendance, and continued by an act
passed
November session, one thousand seven hundred and ninety, for seven
years, be
and is hereby repealed. |

II. And be it
enacted, That the sum of eighteen shillings and nine-pence
current money be allowed to each members of the general assembly for
every day
he shall attend as such, for the purpose of defraying his expences,
besides the
accustomed itinerant charges and ferriages. |

CHAP. LII.
An ACT for the establishment of a warehouse at Beard's Point,
in Anne-Arundel county. |
Proprietor to
erect a warehouse,
&c. |
BE it enacted,
by the General Assembly of Maryland, That the proprietor or
proprietors of Beard's Point, on the south side of South river, in Anne-Arundel
county, be and he or they are hereby authorised to erect, at his
or their own expence, a good and sufficient warehouse for the reception
and inspection
of tobacco, and that the proprietor or proprietors aforesaid be authorised
and empowered to charge and receive one quarter of a dollar on each hogshead
of tobacco there inspected, as compensation for the expence of erecting
and
keeping in repair the said warehouse, and in lieu of rent, to be paid before
such
hogshead shall be removed. |
