and visitors of King William's school, in the same manner and to the
same uses, intents and purposes, as they now hold the same; and if
at the
time of breaking the said terms and conditions, it shall happen that these
shall not be a sufficient number of the said rector, governor, trustees
and
visitors, living, or if those living shall decline to act, so that there
shall not
be a sufficient number to hold and apply the said property, and to exercise
the powers which they now have, the governor and council for the time
being, shall appoint so many proper persons to be rector, governors, trustees
and visitors, as shall make up the number at this time by law empowered
to act; and if at the time of such breach of terms and conditions,
or
after such breach and before any act shall be done, it shall happen that
none of the present rector, governors, trustees and visitors shall be living,
or if all shall decline to act, then the said property shall be vested
in the
governor and council for the time being, and their successors, who
shall,
without delay, appoint a sufficient number of proper persons to be rector,
governors, trustees and visitors, of the said school, who shall receive
and take the said property, to be held, managed and used, by them and
their successors, for the uses, intents and purposes, for which it
was originally
granted; and the persons so to be appointed, shall perform the
same duties and have the same powers as the present body corporate at
this time perform and enjoy; and those persons who shall, upon any
breach of terms or conditions as aforesaid, be under this act entitled
to
hold the said property, shall have power, by the name of the rector
and
visitors of Annapolis school, to sue in any court of law or equity, as
the
case may be, and therein to recover the sid property from the visitors
and governors of Saint John's college, or from any other person or persons
to whom it shall have been illegally conveyed, or to recover the full value
of the said property from the said visitors and governors of Saint John's
college, in case they shall have conveyed the said property, having authority
as visitors and governors to convey the same; and the body corporate
for managing the interests of the said school in Annapolis, shall hereafter
be known and distinguished, on all occasion on which they shall be mentioned,
by no other name than of the rector and visitors of Annapolis school,
and they shall always from the passage of this act, implead and be impleaded,
grant and convey, receive and take, by that and by no other name. |
Preamble. |
WHEREAS the vestry of Saint Paul's parish, in Baltimore
county, by their humble petition to this general assembly,
have set forth, that there is no ground belonging to the said
parish, convenient to build a house on for the residence of the minister
of the parish church thereof, and that John Eager Howard, Esquire, hath
offered to give a piece of ground for that purpose, adjoining the town
of
Baltimore, containing one half acre and twenty-eight square perches of
land, being part of a tract of land called Lun's Lot, and to convey the
same
to the said vestry, and their successors, for ever, for the purpose
of erecting
a parsonage thereon, for the use and benefit of the minister of the said
church for the time being, provided the leave of the legislature of this
state
be obtained for that purpose, agreeably to the constitution and form of
government; and this general assembly, desirous of promoting the laudable
and pious purposes of the petitioners, have granted leave accordingly. |
