XXXVI. |
II. And be it
enacted, That instead of the poundage fees allowed to the
sheriff by the said first mentioned act, he be allowed only at the
rate of seven
and a half per cent. for the first ten pounds in money, or one thousand
pounds
of tobacco, and the rate of three per cent. for the residue, in
the same specie the
execution shall issue for; and that where execution or attachment shall
be made
on lands held for years, or a greater estate, only one half the same poundage
fees
shall be chargeable, but if the estate in the land shall not be charged
by appraisement,
and delivery to the plaintiff, or by sale of the sheriff, one quarter part
of the said poundage fees only shall be chargeable. |

III. And be
it enacted, That from all attornies, clerks of the general and
county courts fees, there shall be a deduction of one fifth. |

CHAP. XXXVII.
An ACT for the sale of inspected tobacco in certain cases. |

II. Be it enacted,
by the General Assembly of Maryland, That the inspector
or inspectors of the several warehouses shall, and they are hereby obliged
and required,
at the September, October, or November county courts, yearly, during
the continuance of the act to prevent the exportation of unmerchantable
tobacco,
to return to the justices a distinct and fair list of the marks, numbers
and weights,
of every hogshead of tobacco then in their several warehouses respectively,
that
have been inspected above three years, to be lodged with the clerk of the
county;
and the justices of such court are hereby required to cause a copy of the
said list
to be immediately set up at the court-house door, advertising the said
tobacco
therein mentioned to be sold on the third day of the same courts, if fair
weather,
and if not, the next fair day, and shall cause the same to be sold at the
time
aforesaid at public vendue in single hogsheads, and the produce thereof
shall be
applied to the defraying the county charge; and whenever thereafter the
owner
or owners of such tobacco shall claim the same, or any part thereof, and
make
his, her, or their property, appear to the satisfaction of the said justices,
then
the said justices shall assess, in the next county levy, such sum of money
as the
said tobacco sold for, for the use of the said owner or owners. |

CHAP. XXXVIII.
An ACT to continue the acts of assembly therein mentioned. |

BE it enacted,
by the General Assembly of Maryland, That an act of assembly,
entitled, An act for the relief of such persons as cannot find security
for their appearance to testify as a witness against any person arrested
or
prosecuted for any criminal matter, made at a session of assembly begun
and held
at the city of Annapolis the third day of June, seventeen hundred and fifty-two,
be and is hereby continued, and shall remain and be in full force for and
during
the term of seven years, and to the end of the next session of assembly
which
shall happen thereafter. That another act of assembly, entitled,
An act to enable
the several and respective county clerks within this province to remove
some of
the county records and papers from the public offices, made at a session
of assembly
begun and held at the city of Annapolis, the tenth day of Mary, seventeen
hundred and forty-eight, be and s hereby continued, and shall remain and
be in
force for and during the term of seven years, and to the end of the next
session of assembly which shall happen thereafter. That another act
