XXXVII. |

reposed in them by this act, and to pay to the treasurer of the western
shore the
amount of the debts due from the said Archibald Buchanan to the state aforesaid,
in final settlement certificates as aforesaid, if the said land shall sell
for a sum sufficient
for that purpose, after paying the expences attending the sale thereof,
and
if the said lands should not sell for a sum sufficient for that purpose,
to pay so
much as the said sales shall amount to, after deducting the aforesaid expences
attending the same; saving the right of any creditor of the said Archibald
Buchanan,
by judgment obtained before the judgment rendered as aforesaid on behalf
of
this state against the said Nicholas Rogers and wife, the heir of the said
Archibald;
and saving also to the said Nicholas Rogers and wife, the costs by
them
sustained in the suits against them by this state, if by law they are entitled
to retain
the said costs out of the value of the lands descended to the wife of the
said
Nicholas. |

VI. And be it
enacted, That the said trustees shall be allowed a commission of
five per cent. for their trouble in executing the powers intrusted
to them by virtue
of this act. |

CHAP. XXXVIII.
An ACT vesting certain powers in the commissioners of the tax
of Anne-Arundel county. |
Commissioners
to divide
the county
into districts,
&c. |
BE it enacted,
by the general assembly of Maryland, That the commissioners
of the tax for Anne-Arundel county, be and they are hereby empowered
and directed, to divide the said county into convenient districts, not
exceeding
seven, and to appoint a collector in each district, who shall, on giving
bond with
sufficient security, to be by them approved, proceed to make the collection
in his
respective district; and the said commissioners may allow the said collectors
a reasonable
time to make their collection; provided a final settlement with the treasurer
shall take place on or before the twentieth day of September next. |
Powers of
collectors,
&c. |
II. And be it
enacted, That the collectors, who shall be appointed by virtue
of this act, shall have the same power in their respective districts, as
are given to
collectors in their respective counties, and they shall be entitled to
the same commission
on collection, and subject to the same penalties, as collectors are liable
to
by the said act. |

CHAP. XXXIX.
An ACT to repeal the fortieth section of the constitution and form
of government. |
Preamble. |
WHEREAS the fortieth section of the constitution
and form of government
in the following words, that is to say, " That the chancellor, all
judges, the attorney-general, clerks of the general court, the clerks
of the county courts, the register of the land-office, and the register
of wills,
shall hold their commissions during good behaviour, removable only for
misbehaviour,
on conviction in a court of law, " is inconsistent with the thirtieth section
of
the declaration of rights, and great inconvenience and injury to the public
and individuals
may result from officers of government being removable only for misbehaviour,
on conviction in a court of law; |
The fortieth
section reposed,
&c. |
II. Be it enacted,
by the general assembly of Maryland, That the said fortieth
section of the constitution and form of government be repealed, and any
officer
mentioned in the same fortieth section shall be removed for misbehaviour,
on conviction
in a court of law, and may be removed by the governor, upon the address
of the general assembly; provided, that two thirds of all the members of
each
house concur in such address. |
When to take
place. |
III. This act to take place on its being confirmed
by the general assembly,
after the next election of delegates in the first session after such new
election, according
to the constitution and form of government. |
