CHAP. XXIII.
An ACT to lay out several turnpike roads in Baltimore county. |

WHEREAS the public roads leading from Baltimore-town
to the western
parts of this state, by manes of the great number of waggons,
that use the same, are rendered almost impassable during the winter
season, and the ordinary method of repairing the said roads is not only
insufficient,
but exceedingly burthensome; and the establishment of several turnpike
roads in the said county would greatly reduce the price of land-carriage
of produce and merchandise, and raise the value of the land in the said
county,
and considerably increase the commerce of the state; |

II. Be it enacted,
by the general assembly of Maryland, That John Ellicott,
Edward Norwood and Thomas Hollingsworth, and any two of them, shall be
and are hereby appointed commissioners to examine, survey, lay out and
mark,
a public road from Baltimore-town towards Frederick-town in Frederick county,
to the line of Baltimore county, sixty-six feet wide, and on as streight
a line from
Baltimore-town to Frederick-town as the nature of the country will permit;
and
the said commissioners are to consider, not only the distance, but the
situation
and goodness of the ground on which the said road is to pass provided,
that the
said road shall not be carried through any building, orchard, garden or
yard,
without the consent of the owner or possessor thereof. |

III. And be
it enacted, That Charles Carnan, Robert Lyon and Henry Wilson
and any two of them, shall be and are hereby appointed commissioners to
examine, survey, lay out and mark, a public road from Baltimore-town to
Reister's-town,
in the said county, of the width aforesaid, and in the manner aforesaid. |

IV. And be it
enacted, That Charles Walker, Cornelius Howard and Richard
Owings, or any two of them, shall be and are hereby appointed commissioners
to examine, survey, lay out and mark, a public road from Reister's-town
aforesaid
to Winchester-town, of the width aforesaid, and in the manner aforesaid. |

V. And be it
enacted, That Nathan Cromwell, Electius Lemmon and George
Nace, or any two of them, shall be and are hereby appointed commissioners
to
examine, survey, lay out and mark, a public road from Reister's-town
aforesaid
towards Hanover-town to the line of Baltimore county, of the width aforesaid,
and in manner aforesaid. |

VI. And be it
enacted, That Benjamin Griffith, Elijah Merryman, Richard
Johns, Thomas Gist and WIlliam Gwinn, or any three of them, shall be
and
are hereby appointed commissioners to examine, survey, lay out and mark,
a public
road from Baltimore-town towards York-town to the line of Baltimore
county, of the width aforesaid, and in manner aforesaid. |

VII. And be
it enacted, That Otho Holland WIlliams, Charles Ridgely, son
of William, Benjamin Nicholson, James Gittings and Daniel Bowley, and any
three of them, shall be and are hereby appointed commissioners of review
of the
said roads, and of the proceedings of the said commissioners in virtue
of this
act; and the commissioners aforesaid, appointed to survey and lay out the
said
roads, after they shall have laid out and marked the same, are hereby directed
to
return the courses and plots thereof, with their remarks and observations
thereon,
to the said commissioners of review, who are hereby authorised and required
to
view and examine the several roads aforesaid, and thereafter to confirm,
correct
and alter, the same, as they shall adjudge proper; and the said commissioners
of review shall cause to be made out three fair plots and certificates
of the said
roads, containing the courses thereof, and in such other descriptions as
they may
think necessary, and they shall sign their names to each plot and certificate,
and
return one certificate and plot to the clerk of Baltimore county,
and another to
the commissioners of Batimore-town, to be by them respectively recorded,
and
they shall deliver the third to the commissioners appointed to lay out
the said |
