the provincial court, at the suit or on behalf of the plaintiff or plaintiffs,
in order
for trial, and therein the sum recovered or assessed shall not exceed twenty
pounds
sterling, or twenty-six pounds thirteen shillings and four-pence current
money,
or five thousand pounds of tobacco, in every such case also, no costs shall
be adjudged
or awarded to the party, plaintiff or plaintiffs, any law, statute, usage
or
custom, to the contrary notwithstanding. |

CHAP. I.
An ACT confirming to Samuel Cookson of Baltimore county, sundry lands
therein
mentioned. PR. |

CHAP. II.
An ACT to prohibit raising swine and geese in George-town, in Frederick
county.
No person shall keep any swine or geese
therein, unless in enclosures; and it shall be lawful to destroy
them if going at large. And any person sued for so destroying them,
may give this act and the special
matter in evidence upon the general issue. |

CHAP. III.
An ACT reviving and continuing an act, entitled, An act for amending
and repairing
the public roads in Baltimore county. |

CHAP. IV.
An ACT to prevent the exportation of flour not merchantable
from George-town, in Frederick county. |
|
WHEREAS it is represented, that discoveries have
been made of certain
deceits practised by the manufacturers of flour, to the great prejudice
of the buyers thereof, and injurious to the community: For the encouragement
and advancement of that branch of trade at the said town, |
Preamble. |
II. Be it enacted,
by the right honourable the lord proprietary, by and with
the advice and consent of his lordship's governor, and the upper
and lower houses of
assembly, and the authority of the same, That the commissioners
of George-town,
or the major part of them, for the time being, shall assemble and meet
between the
first and twentieth of December next, and between the said first and twentieth
day of
December yearly, and every year, during the continuance of this act, and
then nominate
and appoint a person of good repute, and skill in the goodness and quality
of flour, to be inspector of flour within the said town, for the year ensuing. |

III. And be
it further enacted, That every commissioner of the said town, who
shall vote for the said officer, shall take the following oath before he
shall vote for
the nomination and appointment of the officer aforementioned, to wit:
" I, A. B.
" do swear, that I will faithfully appoint such person to be inspector
of flour within
" the town of George-town, as I think, in my judgment and conscience, is
fit
" and capable to execute the said office." |

IV. And be it
further enacted, That in case of the death of the said officer so
nominated and appointed, or the refusal or inability of him to act, the
said commissioners,
or the major part of them, shall, as soon as conveniently may be thereafter,
meet together, and nominate and appoint one other such person as aforesaid,
in the stead and place of any person so dying, refusing, or becoming incapable
to
act, for the residue of the year then to come; and if the said commissioners
shall
neglect and omit to nominate and appoint the said officer, then, and in
such case,
the governor or commander in chief of this province for the time being,
may, by
warrant under his hand, constitute and appoint another officer, who shall
have the
like power and authority as if he had been, by the said commissioners,
regularly
nominated and appointed. |
In case of
death, another
to be appointed. |
V. And be it
further enacted, That all wheat flour, bolted and brought to the
said town for exportation, from and after the first day of January next,
shall, by
the bolters thereof, be made merchantable, and of due fineness, without
any mixture
or coarser or other flour, and well packed in good strong well seasoned
casks,
with the true thereof marked thereon. |
