LXX. |
LAWS of MARYLAND.
To execute all these various duties,
he is authorised to choose an assistant, who, as well as himself, is to
take an oath of office. And, before the intendant
enters on his office, he is, before the executive, to give
bond with security in the sum of £. 20,000, for
the faithful performance of his duty. In case of a vacancy
in this office, the appointment is vested in the executive.
Other duties and powers have been
conferred on the intendant by other acts; but his office was suffered
to terminate at the period fixed by the act. |

CHAP. LXXI.
An ACT to empower James Wignell to sell the real estate of John Ashburner,
deceased, for the payment of his debts. PR. |

CHAP. LXXII.
An ACT enabling the governor to exercise certain powers therein
mentioned. |
| Preamble. |
WHEREAS certain provisions were made for the benefit
and relief of
disabled and maimed officers, soldiers and mariners, by an act passed
at the October session, seventeen hundred and seventy-eight, and the
execution of the said law was given to the justices of the orphans
court in each
county: And whereas the officers of the Maryland line under such
circumstances,
have petitioned the general assembly to place the execution of said
law in the
hands of the governor, so far as said law relates to commissioned officers;
and it
appearing reasonable and proper to this general assembly to grant their
petition, |

II. Be it enacted,
by the general assembly of Maryland, That the execution
of so much of said law above recited as relates to commissioned officers
of the
Maryland line, be placed in the hands of the governor, and he is hereby
authorised
to exercise the powers given by said law, in as ample a manner as the
justices of the orphans court were empowered to do. |

An ACT to repeal such part of the acts of assembly therein mentioned,
as authorised
Thomas Contee to collect the debts of William Molleson

CHAP. LXXV.
An ACT to authorise the issuing grants for the lands therein mentioned. |
| Preamble. |
WHEREAS, by the act, entitled, An act to appropriate
certain lands
to the use of the officers and soldiers of this state, and for the sale
of
vacant lands, it was enacted, that all the lands within this state in
Washington county, westward of Fort Cumberland, and for which located warrants
had not issued or surveys been made under common warrants, and were
then bonâ fide the property of any subject of this or any
of the United States,
and on which the money had been actually paid, should be and were thereby
appropriated
to discharge the engagement of lands thereto made to the officers and
soldiers of this state, and the residue to the use of the public, as the
general assembly
should thereafter direct, and that no grant should issue on any survey
made in virtue of such warrants before the order of the general assembly:
And
whereas divers of the citizens of this state are justly entitled to have
their titles
perfected in lands lying to the westward of Fort Cumberland, on certificates
of
survey made before the passing of the said act, in virtue of warrants fairly
obtained
and duly executed, and the with-holding their patents, is not only prejudicial
to them but injurious to the state, in delaying the settlement and improvement
of those lands, |

II. Be it enacted,
by the general assembly of Maryland, That at any time after
the first day of July next, a grant may issue in the usual mode to any
citizen of
this or any of the United States, for any land within this state westward
of Fort
Cumberland, regularly surveyed, by virtue of a special or common warrant
obtained |
