                                WILLIAM PACA, Esq; Governor.

Gay-street, of the width of one hundred and fifty feet, to Water-street, with
the privilege of extending the same to the Channel; and that the said market-house,
when erected, and the ground whereon the same shall be built, with the
privilege aforesaid, shall be, and is hereby declared to be, vested in the commissioners
of Baltimore-town and their successors, for ever, from and immediately
after the said market-house shall be built and erected, to hold, possess and enjoy,
the same market-house, ground, and privilege aforesaid, to and for the use and
benefit of the said town, in as full and ample manner, as if the said commissioners
had been legally constituted a body politic and corporate in deed and in
name; provided always, that the said Samuel Smith, William Patterson, John
McLure, David Harris, Thomas Yates, James Jaffray, Englehard Yiefer, Abraham
Vanbibber, and Thomas Elliott, or a major part of them, shall, on or
before the fifth day of March next, enter into a bond, in the penalty of five
thousand pounds current money, payable to the commissioners of Baltimore-town
and their successors, with condition, that they the said Samuel Smith,
William Patterson, John McLure, David Harris, Thomas Yates, James Jaffray,
Englehard Yiefer, Abraham Vanbibber, and Thomas Elliott, or a major part
of them, shall erect and build the said market-house in a good substantial workman-like
manner, according to such plan and dimensions as the commissioners
of Baltimore-town shall approve, on or before the first day of March, in the
year one thousand seven hundred and eighty-seven.

CHAP.
 LXII.

    III.  And be it also enacted, That colonel John Eager Howard, William
Hammond, Jonathan Hudson, William Goodwin, doctor Lyde Goodwin, and
Leonard Harbaugh, or a major part of them, shall have full powers and authority
by this act, to build and erect a market-house on a space or parcel of ground
to the westward of the Bason, situate in a square, extending and bounding on
Hanover-street one hundred and sixty-six feet, and on Cambden-street one hundred
and ninety-eight feet, and that the sid market-house when erected, and the
said square of ground on which it shall be built, shall be, and is hereby declared
to be, vested in the commissioners of Baltimore-town and their successors, from
and immediately after the said market-house shall be built and erected, to hold,
possess, and enjoy the same, to and for the use and benefit of the said town, in
as full and ample manner, as if they the said commissioners had been legally
constituted a body politic and corporate as aforesaid; provided always, that the
said John Eager Howard, William Hammond, Jonathan Hudson, William
Goodwin, Lyde Goodwin, Leonard Harbaugh, or a major part of them, shall
in like manner, on or before the first day of March next, enter into bond, in the
penalty of three thousand pounds current money, payable to the said commissioners
and their successors, with condition, that they the said John Eager Howard,
William Hammond, Jonathan Hudson, William Goodwin, Lyde Goodwin,
and Leonard Harbaugh, or a major part of them, shall erect and build the said
market-house in a good substantial and workman-like manner, according to such
plan and dimensions as the said commissioners of the said town, or the major
part of them, shall approve, on or before the said first day of March, in the year
of our Lord one thousand seven hundred and eighty-seven.

    IV.  And be it further enacted, That the commissioners of Baltimore-town,
or a major part of them, shall have full power and authority, as soon as conveniently
may be after the new market-house on the said marsh shall be extended
and built up for the length of three hundred feet from Baltimore-street, to lay
off the ground which was heretofore leased for the use of the present market-house
into convenient lots, and the same, together with the buildings thereon,
set up and expose to public sale to the highest bidder, under such conditions as
they may think proper, and three fourths of the monies arising from the sale of
the same, when sold, to appropriate for building and erecting the said new market-house
on the said marsh, and completing the public wharfs adjoining the
same; and the said commissioners, or a major part, are hereby authorised to
make and execute, in due form of law, proper deeds of conveyance to the purchaser
or purchasers of the said lots of ground, or any part thereof, on payment
of the purchase money for the same; and the said commissioners are hereby authorised
