II. Be it enacted,
by the general assembly of Maryland, That the commissioners
of Baltimore-town aforesaid, or the major part of them, be authorised and
required,
at any time before the first day of September next, to cause the aforesaid
tracts of land and premises, or such parts thereof as they may think necessary,
to
be surveyed and laid out into lots, streets, lanes and alleys, at the proper
cost
and expence of the proprietors thereof, in such manner as to the said commissioners,
or the major part of them, shall seem convenient. |

CHAP.
VIII.
Commissioners
to cause
land to be surveyed,
&c. |
III. And be
it enacted, That the commissioners aforesaid, or a major part of
them, shall, on or before the first day of September next, cause a correct
and
accurate survey and plot to be made of the said tracts and parcels of land
aforesaid
so laid out, and of all lots, streets, lanes and alleys, which shall be
laid out
in virtue of this act; and the said plot shall be recorded amongst the
records of
said town, as soon as conveniently may be thereafter, there to remain as
evidence
of the boundaries, situation and location, of the said lots, and of the
streets,
lanes and alleys; which said streets, lanes and alleys, hereafter to be
laid out in
pursuance of this act, shall be highways, and be so deemed and taken to
all
intents and purposes whatsoever; and when the same shall be done, the said
tracts
and parcels of land and premises, so surveyed and laid out, shall be, and
is hereby
declared to be, part of Baltimore-town, as fully and amply as if included
originally therein, and shall have the same immunities and privileges as
the said
town has, or by former laws ought to have, saving to the state of Maryland,
and
all bodies politic and corporate, and all persons not mentioned in this
act, their
several and respective rights. |

IV. And be it
enacted, That the commissioners aforesaid shall, on or before
the first day of September next, cause their proceedings to be recorded
amongst
the records of said town, there to remain as evidence of the boundaries,
situation
and location, of said lots, and of the streets, lanes and alleys, aforesaid. |

V. And be it
enacted, That the several proprietors aforesaid, and their heirs
and assigns, shall respectively have the sole and exclusive right and authority,
with
the approbation and consent of the commissioners aforesaid, or a major
part of
them, to appropriate, dispose of and convert, the timber and wood growing
on
the earth, and sand lying in such of the said streets, lanes and alleys,
as are laid
out in their several and respective parts of the said tract of land. |

CHAP. XI.
An ACT for laying out a road from Philip Shoal's mill, in Baltimore
county, until it intersects the main road leading from
Frederick-town
to Baltimore-town, between Mansell's and Hood's
tavern, in Anne-Arundel county. |

WHEREAS it is represented to this general assembly,
by the petition of
sundry inhabitants of Anne-Arundel and Baltimore counties, that they
labour under great inconvenience, for want of a waggon road from
Philip Shoal's mill to the main road leading from Frederick-town to Baltimore-town;
and it appearing reasonable to grant the petition, |
Preamble. |
II. Be it enacted,
by the general assembly of Maryland, That John Hood, Nicholas
Dorsey, and Philemon Dorsey, or any two of them, be and are hereby
appointed commissioners, and are hereby authorised to lay off a waggon
road,
twenty feet wide, from the said Philip Shoal's mill, in Baltimore county
aforesaid,
until it intersects the main road leading from Frederick-town to Baltimore-town,
between Mansell's and Hood's tavern, in Anne-Arundel county; which
said road, when laid out, shall be public road. |
