vestryman or vestrymen, register or registers, churchwarden or churchwardens,
refusing or neglecting the office and duty required of them by this
act, shall not
be construed or understood to make any person or persons liable to
such choice or
penalties, who shall not be publicly known to be of the possession
in religion
known by the name of the Church of England, any thing in this act contained
to
the contrary thereof in anywise notwithstanding. |

CHAP.
IX. |
XV. And be it
enacted, That the select vestries so to be chosen, and their successors,
shall, as trustees of the parish, be vested with an estate in fee in
all the
glebe-lands, as also in all churches and chapels, and the lands thereunto
belonging,
late the property of the people professing the religion fo the Church
of England,
and also as trustees aforesaid shall have full property in all books,
plate, and other
ornaments, belonging to said churches and chapels, or any of them. |

XVI. And be
it enacted, That the said vestryman, or the major part of them,
shall have full power and authority to employ a minister or reader
of the Church
of England, to officiate in their respective churches or chapels, for
such time as
may be agreed upon; and may take in subscriptions from all persons
willing to
contribute towards the support of such minister or reader, and also
for the support
of a clerk to such minister, and giving a salary not exceeding thirty
pounds to the
register of such vestries. |

employ a minister,

XVII. And be
it enacted, That the possession and free use of all glebe-lands
shall belong to the minister of each parish, from the time of his having
agreed
with the select vestry as aforesaid, for and during the time he shall
continue to
officiate therein as minister of the parish; and he shall be entitled
to all the profits
thereof during the time aforesaid, any thing herein contained to the
contrary
notwithstanding. |

CHAP. XV.
An ACT for removing sundry original papers in the late prerogative
office to the
several orphans courts in this state, and such original
papers lodged in the late
secretary's office as relate to suits in the general
court for the eastern shore.
The papers in the late provincial court
office, relating to the business of the eastern shore now depending,
are, by the officer having the care of them, to be sorted,
distributed, separately packed up,
and, before the ninth of April next, transmitted, under
the care of some trusty person, to the clerk of the
general court on that shore; and, for this service, he
is to have the sum of £. 75. Papers in the late
prerogative office from the year 1760, belonging to estates not finally
settled, in like manner, by the first
of October next, are, by the officer having the care of them, under the
penalty of £. 20, to be sent to
the several registers; and, for this service, he is to have the sum of
£. 300. The register of Frederick
county, under the penalty of £. 20, is to separate, sort and pack
up, the papers belonging to Washington
and Montgomery counties, and transmit them, within 20 days from his own
receipt of them. The
register of Baltimore county is to perform a similar duty with respect
to the papers of Harford county.
The registers of Queen-Anne's and Dorchester are to perform a similar service
with respect to Caroline.
And all these several officers are to be paid by their respective counties
a reasonable compensation. |
