delaying of Execution that then this Recognizance Shall be voyd and of none
Effect otherwise to Stand and bee in full force and vertue.

John Deakins plantiffe: Michaell Ashforth Defendant.

Prince Georges County Court Ss. Michaell Ashforth Late of Prince Georges
County planter was Atteched to Answer unto John Deakins of a plea of trespass
upon the Case etc.

And Whereupon the Said John Deakins by Joshua Cecell his Attorney Com-
playneth that whereas the Said Michaell Ashforth the 15th day of Aprill in the
yeare of our Lord 1696 att Charles County that is to Say att Charles Towne
within the Jurisdiction of this Court was Indebted unto the Said John Deakins
the Sume of two thowsand Eight hundred and Seaventy five pounds of tobaccoe
and Eleven Shillings Sterling money upon the ballance of Accounts being as well
for divers goods Sold and delivered him the Said Michaell Ashforth as alsoe for
worke done and money Lent as by a pertickeler Account thereof here in Court
produced Relation being thereunto had may more at Large Appeare And the
Said Michaell Ashforth to the Said John Deakins in manner aforesaid being
Indebted Inconsideration thereof did Assume upon himselfe and to the Said John
Deakins then and there faithfully promise that him the Said Michaell Ashforth
him the Said John Deakins the Said Sume of 2875 lbs. of tobacco and lid
Sterling money when he the Said Michaell Ashforth Should be by the Said John
Deakins thereunto Requested would well and truly Content and pay Nevertheless
the Said Michaell Ashforth his promise and Assumption Soe as aforesaid made
not at all regarding but minding and Fraudulently intending him the Said John
Deakins in this behalfe Craftily and Subtilly to deceive and defraud the Said
Sume of 2875 pounds of tobacco and lid Sterling money to the Said John
Deakins hath not paid Although the Said Michaell Ashforth to doe the Same
by the Said John Deakins Afterwards the day and place aforesaid was often
thereunto Requested but the Same to pay hee hath denyed and Still doth Refuse
and denye to the damage of the Said John Deakins of 4000. lbs. of tobaccoe and
thereupon he brings this Suite etc.
