And the Said William Herbert by William Stone his Attorney comes and
Defends the force and Injury when etc. and Prayeth Lycence to imparle here
untill the Next Court comeing and it is granted unto him the Same day is
given to the Plantives Likewise, Att which day to witt the 26th day of Septem-
ber Annoque Domini 1699 hear came as well the Said Kathrine Willson and
Joshua Cecell in their Proper persons Plantives as the Said William Herbert
by his Attorney aforesaid and the Said Kathrine Willson and Joshua Cecell
Prayeth that the Said William Harbert to their Declaration aforesaid may
answer.

[493] And the Said William Harbert by his Attorney aforesaid cometh and
defendeth the force and Injury when etc. and Saith that he oweth not the Said
Plantiffs the Said 1038 lbs. of Tobacco nor any Part thereof alleageing that the
Said Defendant had an account against the Said Jonathan Willson for twelve
hundred 21 pounds of Tobacco which was Proovd in open Court by the Oath
of the Said Defendant as by the Said account filed may appear and therefore
Putts himselfe upon the Court. by Consent William Stone.

And the Plantives allso. Joshua Cecell.

Whereupon the Court haveing read and Fully understood the alligations on
both Sides but More perticularly the account the Defendant made oath upon
in Barr of the Said Action.

Therefore it was Considered by the Court that the Said Kathrine Willson and
Joshua Cecell Executor of the Said Jonathan Willson Deceased take nothing
by their Said writt but be in Mercy for their falce Clamor and lett the names
of the Pledges be Sought for and that the Said William Harbert Goe thereof
without day.

Willsons Executors Plantiff: Isaack Williams Defendant

Isaack Williams Late of Prince Georges County Planter was atteached to
answer unto Kathrine Willson and Joshua Cecell Executors of the Last Will
and Testament of Jonathan Willson Late of Prince Georges County Inholder
of a Plea of Tresspass upon the Case.

And whereupon the Said Joshua for himselfe and the Said Kathrine in his
propper person Complaineth that whereas the Said Isaack in the Life Time of
the Said Jonathan that is to Say the tenth day of October in the year of our
Lord 1697 at Charles Towne within the Jurisdiction of this Court Stood in-
debted unto the Said Jonathan in the Sume of four Hundred and Nine pounds
of Tobacco being for Severall Dyetts Licquors Lodgeings Ordinary Accomada-
